N :;w Yoarl, .luly It0.-A little before 11 o,'clock on Tesday night some of the tenants of IS Monroe street heard a lond cry followed by a noise in the yard. People who ran out found hlie hody of .John IBurke, aged 21, on the :lags of the ya:rd between the front and rear buildings of the tenement house. HiJs skull was fract ured , and he died in a lew minutes. It appears that Burke, who was employed at Havenieyer's sugar refinery in Wil lialnsburg, lived on the top floor of the rear building with his aunt, Miss Kate Mc l;voy, 45 years old, a cook. The two cele brated the Fourth of July in a lively man ner, and before night both were drunk. At about 10 o'clock John asked his aunt to give him $5.. She refused, and a strug gle fbllowed. Burke threw her to the floor, and after striking her several times tried to get at her pocketbook. Miss McEvoy re sisted with all her strenigth, and Burke, who by this time had become furious, bit ottf the top of her left ear. Burke then be cae sorry for what lie had (lone, and burst into tears. His aunt was bleeding freely from the mutilated ear, and Burke offered to summon a physician and left the room. Shortly afterward lie fell from the roof to the yard. The police of the Madison street station were notified, and Burke's body was car ried into a neighbor's room adjoining his own. Miss McEvoy was taken to the sta tion where her mutilated ear was dressed, and she was thenll locked lp) on the charge of intoxication. When arrested, 1 Miss M1cEvoy gave the keys of her room to a neighbor nimed Liz zie Healey, who had been in her conipany in the early part of the evening. At about : .t. ri. yesterday, smoke was seen issuing from Miss McEvoy's rooms, and an alarmn was sounded.
