MAN AND THE STATE
Governments are but the creations of
man and their sole object and justifica
S tion are the regulation of the dealings of
S all kinds whatsoever of man with man
to claim for them any other object and to
S give them any other justification is to
claim for them that which belongs not to
them and to give to them that to which
they are not entitled Various forms of
government are but various expressiolls
of different ideas and nations like men
have their ideal standards and the nearest S
approach to a realization of their ideal is but
an approximation Many centuries are
required for nations to reach a high ideal
standard in art and in literature and for
nations to attain high standards in
theories of government and the political
rights of man has taken still greater time
In art and literature individual men rise
to heights of whose immensity the masses
never dream politics can approach and
Homer and the Iliad are known and read
where Plato and The Republic are never
heard of The reason is that in art and
literature man acts independently of
his fellowman and in a domain
where the State which is the
masses organized on whatever plan
they adopt or suffer to be imposed does
S not come and is not bound by any oth
er power than his own will tnd the limits
of his own genius Not so in government
for there man is limited by the will of the
whole and can only act in politics in ac
coruance wiiii me constitution or his gov
ernment and whatever that constitution
may be written or unwrttten there he
finds his rights and duties defined there
he finds them protected In America
we have adopted a written con
stitution based on the theory the
only true theory to secure freedom
that the powers of the government are
derived from the consent ofthe governed
With us government is a means to an
end 1 that end the liberty of the citizen
S and the right to act for himself in all
things in whatever
manner he may
choose but so that he shall not infringe
on the rights of other citizens For the
government to withhold from any citizen
who is obedient to and in no way contra
venes the law any political rights is for
the government to commit a wrong
against those from whom it derives
its existence True it is that the
charter of our political rights in
this Territory is the Organic S
and aside from that we have no political
rights But the Organic Act is a recog
nition of the American idea of govern
ment which is before all things the
right of the people of a locality to govern
and control the affairs of the locality
but it is expected that the ideas of the
people of the locality will in essentials
be in harmony with the underlying theory S
of the whole country as to the founda S
tion of our institutions which founda S
tion is that government is created for II
man and not man for government
In Utah there are two parties 1
the Peoples Party and the Liberal party 1
neither of which
believes that govern S
ment was created for man the one hold S I
ing that man was created for a church I
S and the other that man was created to
destroy this church 1 while each maintains
that the other is trampling the Constitu S
11011 unuer foot The Peoples Party holds
that the Government has no rights while
the Liberal Party holds that the people
have no rights The Peoples Party Bay
that the Liberal Party wish to enchain
them and hence call for a commission

while the Liberal Party say that
the people are already enchained and
will be until a commission is appointed
forgetting that the enchainment of the
I mind may be broken by the mind itself
while to break the enchainment of the
law is to in
come conflict with a recog
nizod material and tangible authority
an authotity which asserts its rights over
the body the medium of the soul and
mind The enchainment of the mint
by a spiritual authority is subjective with
the individual and
being subjective may
be thrown off when the enchainment be I
comes irksome and the individual de
sires to reassert his independence and
right of intellectual self control
S The contentment of the soul with
the conditions by which it is
surrounded whether created from
S within or accepted from without is a
matter with which the State can have no
concern so long as those conditions are
S not inhaimonious in action and not in I
thought merely For the State to coerce
S thought is for the State to kill thought
and destroy freedom All the State can
S ask is obedience to the law the law being
the expression of the will of the people
And will a commission tend to make
I
S people think for themselves and become
Americans in thought so far as govern
ment is concerned 1 Will the tendency
not rather be to stifle all thought
and postpone indefinitely the day when
all citizens will recognize that their
temporal allegiance is due to the j
government which protects them in their
temporal affairs their property and their
S rights as citizens The religious rights
which are vouchsafed to them by the
i Constitution itself are protected by the
temporal power of the government and
not by the spiritual power of any church
The recognition of this great fact in our
government will be the cure of all our
evils in Utah and to introduce a com
mission would be to prevent such a re
cognition by those over whom
a commission would be placed
But we are told that for a commission
uI there are many precedents and long and
learned articles are written that they may
J be cited And what is the special merit
S of precedent To republican govern
S
ments precedents are what kings privil
eges are to limited monarchies things
cited in support of power and in favor of
the repression of liberty Precedent is
ever a sanction for tyranny never an advocate
vocate for freedom Are commissions
to be called for because there are preced
ents for them It seems that the older
the precedent the more weight it has with
those who are calling for a commission Is
there a special providentce in precedent
If EO the church dominant and militant in
Utah can cite precedent for its preaching
and its practice from creations first dawn
and this from sacred books worshipped
by half the world To establish the the
ory and the fact that in our form of govern
ment the citizen stands first before all
churches that from the citizens the gov
ernment derives its power and that gov
ernment deriving power from any other
source is government usurping power
should be the aim and desire of all Ameri
cans but more especially of those who ad
here to the doctrines of Democracy and
not to follow precedent
DEMOCRACY DENOUNCED
Mr John E Booth of Provo has
been denouncing the Democratic party to
the people of that place The address is
in the usual brusk and brilliant style of
the gentleman and recalls the days
when he was the Demosthenes of the
University only he has not removed the
pebble from his mouth He says that
the foundation of the party is an amal
gamation of the stones of truth and error
but neglected to say which was truth
and which error and which was
most dear to his own soul This
was very wrong in a great leader and In
structor of Section C for he does not ac
quaint his followers with the object
which they are pursuing and they may
find that when it is attained it is not
what they had expected Is it that this
vagueness is a sure sign of the greatness
of the object This wonderful address i
says that they the Democratic party
rail at perhaps 40000 voters and ask
hat these voters vote as the Democratic
party the 85 selfstyled Democrats
ask If memory fails us not this
very Peoples Party have railed at
50000000 of people and yet we
have always thought they had a right
to rail at but not the right to rUle the
50000000 But where has there been
such light shed for political parties as
this statement sheds They ask the
Peoples Party to abandon the celestial
order of marriage when perhaps not one
of the number knows what it is most of
them being single or else married by
some civil officer Just think of it mar
ried by some civil officer Was the like
ever heard beforein Utah This
allusion to marriage by a civil officer re
calls the times when the late President
George A Smith used to call those mei
who were but once married bachelors
The gentleman seems thoroughly imbued
with the celestial order of marriage so
much so that in Provo it is whispered I
that he knows more of and cares more for
celestial marriage than the Ten Com
mandments Yes the Democratic party
in Utah knows something of polygamy
and those who are of it that were born in
polygamy dislike the system because it i
produces such men as the Instructor of
Section C And further we think we
know to whom Mr Booth refers
when he says They talk of the evils of
polygamy and at the same time select a
man as their chief exponent who is of
that issue and who would probably
never have even succeeded as a first
class adobiemaker if it had not been for
polygamous money Perhaps not but
we should never have tried the adobe
making business but should have one
to the Instructor of Section C and learned
to pound sand They ought to join one
side or the other by so doing they would
earn a reward on the other side they
would be respected their courage but
being neither hot nor cold they are fit
only as an emetic and will probably do
some good in getting off useless bile
from both parties We advise the In
structor of Section Cto take one for there
was never seen a man who more needed
one so much does he need it that it has
been said that when the Instructor of
Section C shall be no more that he will
sink into the grave unkempt unknown
uncombed Sulphur and sorgum are re
commended as mild in action and pleas
ant to the taste Take it Bob take it
Bob its better than tea It

The attempt of President Barrios to
consolidate the various republics of Cen
tral America into one grand federation
taking as the model therefor the United
States is a bold attempt and of doubtful
success The very surprise by which lIe
took the people and its completeness is
the thing which augurs so badly l for the
success of the movement The Spanish
American States are of so mercurial
a make that the grand schemes
of today with every prospect of success
become on the morrow defunct under
takings and make one more revolution
to be remembered in history and forgot
ten in memory Among SpanishAme
rican governments a year without revolu
tions is a year without interest and of
rare occurrence If this effort of Barrios
could succeed and the idea become the
accepted one with all Central American
governments it would probably be the
best thing that could happen to that por
tion of the American continent The
idea is a return to the Confederation of
Central America of which Guatemala
formed a part for some eighteen years
when in 1859 she proclaimed a constitu
tion which was modified in 1879 The
legislative power is vested in a National
Assembly elected by universal suffrage
and for a term of six years The President
now is General Rufino Barrios who was
reelected in 1SSO for six years Whether I
the influence of Guatemala is sufficient I
with her sister republics to have this old
idea again adopted is doubtful especially
when we remember that the total area is
estimated at about 41800 square miles

European descent To accomplish revolu
tions and make permanent the ideas
which are embodied in them there is
needed a firmness of individual character
and a feeling of personal interest which
are too rarely found in the mixed

character of the people making the na
tion and can be nothingelse And then
Guatemala is divided at home and for
many years she was under the rule of

ution It is to be hoped Barrios may
succeed not merely by arms but by
