It Has Been Definitely Decided That No
Passengers Will be Carried After
March 15
The passenger agents of the Rock Island
system arrived in Denver direct from Chi
cago by special train Thursday at 230 p
m The train consisted of a new locomo
tive baggage smoker dining car and two
Pullman sleepers The object of their in
cursion among the Rocky mountains at
this Time is in compliance with an order
issued by President Cable It is for the
purpose of having all passenger agent
personally visit every important branch on
the system together with the main line
A and in fact take personal trip over every
rail that forms the horseshoe route The
Denver Actcs says the derivative benefitsb
of this idea will among other things en
able the visitors to have an intelligent
view of the route and foster acquaintance
with representatives of connecting lines
in the larger cities of the system

The Exclusive Fast Mall
It is now settled beyond a doubt that the
fast mail train on the Union Pacific will
carry no passengers after the 15th of
March The government mail authorities
have demanded the fulfillment of
fullment the con
tract requiring schedule time but the
great weight of the Pullman coaches at
tached to the flyer have prevented the
Uni6n Pacific from complying strictly with
the contract It has been found impossi
ble t < make the trip uniformly on time with
a heavy train Accordingly the arrange
ment now decided on is to run to Green
River with an exclusive mail train A new
4 passenger tam will be put on starting
from Omaha enough in advance of the flyer
t reach Green River before the flyer over
takes i There the two trains will be com
bined and go on to San Francisco together
In the same way a fast passenger will
start from San Francisco before the nail
flyer which will overtake itat Green
River and go east together In running
light to Green River each way enough time
will b gained t make the schedule good
for the entire trip Twelve new mail cars
are to be put on the road of the best mod
ern construction They will be lighted by
electricity and heated by1 steam Under the
new arrangements the mail service will be
more prompt and complete and the safety
of passengers assured

struggle with tho infuriated animal he suc
ceeded in stopping the team and averting a
serious disaster As a result of his bravery
ho was made a chevalier
The chevalier is connected by marriage
with one of the most aristocratic families in
New York and is very popular 011 account of
his personal qualities and brilliant ability in
tletualy and artiic1 In the roles of

The Well Known Tenor Who Ilecently
Died in Jfeiv Yorlc
When the Barber of Bagdad was first
sung at the Metropolitan Opera house in New
York a few weeks ago the audience was
charmed by the fine voice of the CadL Herr
Wilhelm Sedhnayer sang the part and sang
it well on that opening night but it i was the
lat l part he ever sang Death had his hand
on the cord that was to ring down the cur
tain on his life at the moment when the stage
manager touched the signal for tho drop t I
fall on the last scene of the Barber of Bag
dadHerr
Herr Sedliaayer was not feeling well when
ho went on the stage that night but true
artist and faithful worker he did the work
of the night conscientiously and well He
even seemed t < put a touch of unusual rich
ness and feeling into his tones Tbe fact that
his voice was never raised in song again gives
this fact a peculiar significance His illness
grew worse became serious and in less than L
a week he died
Herr Sedlmayer received his early training
at the Conservatory of Music at Vienna h
native city He played important lyric tenor
parts at the Vienna Opera house but won his
first great success in the comic opera of
Lortzcing
From Vienna he went t tho Court theatre I
at Munich and hw since sung at all the
principal opera houses of the continent His
European engagement was at Hamburg
where Mr Stanton eiigaged him to go t
New York expressly t take the parts of
Mime in the Nibelungenriug and David in
Die Moistdsinger5 roles in which his suc
cess will b pleasantly remembered by lovers
of the opera
In private life Her Sedknayer was amia
ble and unassuming His wife to whom he
was devoted survives him

the Council Yesterday

The Council was the only branch of the i
Legislature which convened yesterday
The chief topic of interest was the further
discussion of the anticigarette bill
Mr Bryan introduced a second substitute
for C F 22 relating to corporate towns
The bill provides that officers of towns
shall give bonds and gives the officers
authority to establish quarantine regula
tions It provides that in case any fines
imposed by courts are not paid imprison
ment may be resorted to Under its pro
visions town clerks shall make and publish
annual statements A town may be disin
corporated on a petition of threefourths
of the taxpayers and a vote of three
fourths of the electors When such town
has been disincorporated the property
shall vest in the county court in trust for
the inhabitants of the town and the same
is to be used in improvement of the side
walks public squares parks or cemeteries
of that town

Mr Booth moved that when any com
mittee had more than one report to make
in one day that it be admissable to make
said reports in one report In support of
his motion Mr Booth said it would save
considerable time and not consume so much
space in the journal The motion pro

The substitute for C F 22 a bill relating
to the organization of towns was taken up
on third reading
Mr Bryan proposed amend by offering
a second substitute On motion of C C
Richards further consideration of the bill
was postponed and pending third reading
the second substitute was ordered printed

angling over amendments providing the

all hands and the cook should study that
portion and be prepared to make intelligent
amendments After as informal recess the
bill was again taken up and passed all
members but Councilor Hatch voting aye

HF 10 substitute the bill prohibiting
the selling giving or turnishing of tobacco
opium or other narcotics to and the use
thereof by minors was taken up and
adopted in lieu of the original bill and then
was taken up on second reading
Mr Olsen looked upon the bill as an ex
periment and said care should be taken lot
to overreach the matter and make it a dead
letter He favored the striking out of that
portion of section 2 inserted yesterday put
ting the minimum fine 10 and making it a
misdemeanor to violate the act This
would allow the court to fix the penalty
according to the enormity of the
offense from one dollar upwards The
boy who is a heavy consumer of the
weed can no more be prevented from using
it than the man who uses liquor it will
simply drive him to the barn cellar or
other outoftheway place Ibelievein pun
ishing the seller not the user This evil
reaches almost every home and I hardly
think the bill will have the sympathy of the
public
Mr Richards made a point of order on
the fact that it had been decided that the
fine be fixed at from 10 to HOO on the
previous day
Mr Benner moved to reconsider that
action The motion carried
Mr Richards think this bill will be a
popular one We have received more peti
tions on this question than on any other
subject introduced It is a sickening sight
to go down on the sidewalks and see boys
hardly out of their petticoats smoking
cigarettes I this bill can do no more
than drive these boys into the cellar for
heavens sake get them out of sight I
think a little heroic treatment administered
by sending a few boys to the county jail
would tend to check this evil The people
of the territory do not need the money that
the lines will bring in but they do need
the reform I we are to fix a punishment
we should not prescribe one that has no
terrors 1 did not come here to pass bills
by their titles Without this punishment
the bill will be a nullity it will simply be
laughed at I the bill is not passed with
this penalty I am in favor of killing it en
tirely I the reformation can be brought
about by sending few to thejail or reform
school it should be done
Mr BennerI think we ought to con
sider the proper policy to be pursued
There are certain things that belong to the
parent I there is anything which will
touch a rightly constituted parent with se
verity it is to have his children taken from
home by the heavy hand of a policeman I
believe there is nothing so harsh to a
young child and I think we should be very
careful of their tender ieelings I have
grown old in the business of taking care of
young people and know how sensitive they
are I boys indulge in smoking it is be
cause they are thoughtless and happy
hearted It is not the proper way t deal
with these boys by bringing them into the
the police court I believe that the man
who deals in vice should be severely dealt
with and I will go as far as any man here
to punish him I believe in protecting the
home but do not want the policeman with
his billy t enter the home to take away
the innocent child The language to be
used to young people is the language of af
fection the law has no affection in it
You are using a dull tool to do a delicate
work
Mr Olsen It has been my idea that the
bill was t prevent the sale of tobacco and
not to punish the users We have had the
picture presented of the policeman entering
the home and taking away the child The
tastes of the child have been imparted to it
by its father and the appetite has been im
planted in the very marrow of the child
before its birth Tho boy has taken up the
habit because his father is addicted to it
I we could piss a bill to punish the father
I would heartily approve it I we strike
out all of sectidn 2 we will have a bill we
need not be ashamed of in two years from
nowMr BryanI cant keep still on this sub
ject It is the duty of the Legislature to
make laws that are proper It is not a
crime to sell tobacco or any other narcotic I
the crime is in using it improperly It
might properly be used for sheep etc We
can walk down the street and see hollow
oved creatures palling away at a cigarette
Not only boys but men are dying by

Suppose wo see a boy pulling at a cigarette
and a policeman steps up to him and says
Dont you know its against the law to
smoke Well what are you going

the end of it while if there is such a
penalty the policeman can arrest the boy j

would make sneak thieves of all the boys
they would sneak into back alleys and eel
lars to smoke I dont think this will ever
become a law I think if the governo has
any sense he will spoil the face of the bill
by writing veto over it
Mr Benner would like to make an
addition to this bill so a not to make it
so manly to be able to smoke I am in
favor of stopping the use of tobacco This is
the subject I have quarrelled with young
people over for a lougtime I is just as
much crime for men to smoke as for boys
By statistics it has been found that
tobacco has caused insanity and other ner
vous affections in men and it is just as in
jurious to the man as the boy Why does
the father whip his boy Simply because
he is larger and can The man who resorts
to the stick is weak and so it is in this case
You cant reach the man but you apply the
lash to the boy because you can Let us
include all evil doers in this bill

Mr RichardsIt is a sure thing that we
cant pass this bill today and as several
members are absent I think wo should post
pone action Thero has been some question
as to the constitutionality of the bill I 1
dont think anyone would question our
right to pass a law restricting the keeping
of opium joints or other dens We cant say
that you must not cross the street or not
ride in a buggy with four wheels The ob
ject of this bill is to prevent the use of the I
weed by children It becomes necessary
not only to prohibit the selling but the
using I it is no crime for him to smoke
and you try to learn where he got his to
bacco he simply smiles and says I dont
have to tell He becomes a party to the
crime I move that the further considera
tion be laid over until Monday
Mr Bryan suggested that the boy might
be brought into court and

Let me tell those sympathetic creatures
something We do get tired So do the
bank clerks and I suppose there is such a
thing as newspaper men tiring But they
are never singled out as vfo are as objects
of sympathy You may think I am un
greatful I am not I dont want any so
called sympathy from strangers Besides
I would like to inform the sympathizers
that the average shop girl of today is bet
ter off for being such She is well treated
by her employer Of course she has to
work She is not employed as a picture
know a manager in Chicago who never
allows a girl in search of work to leave his
place without one days pay in her pocket
I she is worthy she may be retained
During the crowded season just passed I I
know of many shop girls who were not only
given extra pay and furnished with lunches I
and dinners but given valuable presents
and their home people were in some in
stances remembered by managers and em
ployers Many did not receive such con
sideration and I have no doubt that in a
majority of cases they did not receive it

girl attends to her business she will ge
along all right and wont need so much
sympathy

A THRILLING RESCUE
How a Ulan Was Saved from a Lingering
Death
Journalists have of late years done a good
deal of detective work but the recent life
saving operation at San Francisco by news
paper men is a novelty Antonio Nicholas
and several other fishermen who were oat in
the ocean in a smack were capsized and
were obliged to swim for their lives An
tonio swam for a small rock and reached it
The rest were drowned There he clung
buffeted by the waves At last he was seen
and a party of men from the office of The
San Francisco Examiner chartered the tug
Sea Queen and went out to rescue him

of men were in the caisson at the river bot
tom excavating for a foundation Suddenly
there was an escape of air and water rus > xl

but all except four were too late The rest
were drowned
John Knox was on the caisson with a gong
of men It was the duty of the loner lock
tender Baldwin to bo below The men had
been engaged in shoveling sand on one side
and were preparing to low the other side
Baldwin was not nt his post Knox how
ever thinking all would be rightwent ahead
