Several of the western Colorado
papers have been pulling their hair
and rending their linen over the fact
S that the Utes have been kilUng game
in the mountains near their reserva
tion In a recent interview Gen A
McD McCook commander of the de
partment of the Colorado put a
quietus on the objections by saying
Under their treaty with the United
States the Ute Indians owned all the
gam in the mountains around their
reservation They obtained this privi
lege when their lands were relinquished
to the public domain by the red skins
The treaty reads as follows The
said United States shall permit the
Ute Indians to hunt upon said lands
so long as the game lasts and the In
dians are at peace with the white
people
That clause said the general
shows that they did not reinquish the
game and they have a right to come
into the state and kill it all in one
day If they want to and the honor of
the United States is bound to back
them in it The Navajo Indians have
no right to come into Montezuma
county and I have issued orders to
have them kept out of the state
Neither the game warden the gover
nor nor the president of the United
States has the power to prevent the
Utes coming to get their game when
ever they want to It is my duty to
S see that Indians are protected as the
treaty prescribes Every head of game
Is theirs whenever they want to go
after it provided they dont get to
shooting white people

of Mr Frederick W Penford of Salt
Lake city to a young gentleman who
was her s ± ooimate there a few years
ago and is now a wellvOdo merchant
and stockman of western Nebraska

holds a responsible position with

Salt Lake He was formerly a sales
man in their store at this place and
during the several years of his resi
dence here was very popular and
highly esteemed in this community

Slaughtered Deer For Their Hides
A band of Northern Utes have been
slaughtering deer over in the lower
White river country being camped at
the head of Spring Gulch The band
was headed by leny and Gus Colorow
sons of the wily old chief Early Tues
day morning Game Warden C M White
met the band and after a long con
ference hI ally persuaded them to re
turn to eservation in Utah Mon
day M v Tt arrested and brought

who are reported twentyfive miles
north of Rangely with teams slaughter

Gypsum in Wyoming
J G Bullock of Lone Tree Uinta
county Wyoming who is in Laramie
brought a fine specimen of what he
thought was a very superior quality of
gypsum which was taken from a ledge
at least 450 feet long and in a position
to be easily worked Chunks of 400
pounds weight can be taken out From
appearance the crystals have no impuri
ties or discoloration in them The de
posit is a valuable find if it proves to
be gypsum An assay will probably
be made at the university as soon as
some of the substance is shipped Lar

Assault and Battery
The Sun mentioned a couple of days
ago that an application had been made
for a receiver for the business of Sam
Berger Co When the officer went
to enforce the mandate of the court
there was quite a row precipitated in
which Mr and Mrs Bergman ejected
Mrs Sallie Karchmer the partner
from the place Prosecuting Attorney
Van Orsdel filed a criminal complaint
against Mr and Mrs Bergman this
morning at the instance of Mrs Karch
mer charging them with assault and
battery Justice Glafcke made out a
warrant which is in the hands of the
proper officer for service Cheyenne

MaT Not Recover
It willbe remembered that Dr Loyd
Whiting of Lupton Col attempted
to commit suicide in Cheyenne two
or three weeks ago He was taken to
the county hospital and has been there
ever since At first it appeared that
he would recover quickly but complica
tions have set in and It now seems
that it is only one chance in ten that
he will recover The wound he made
with the case knife just below the
heart was a very deep one He told
County Physician Wyman that he
drove the case knife in the full length
at that point It was found necessary
to perform an operation on him yes
terday and over a pint of puss was
S taken from him It would now seem
that the doctor not only attempted sui
cide but that he will probably succeed
in his effort

Switchman Claude Glade was SF
iously if not fatally injured in the
yards in this city last evening He
was caught between a moving and
standing freight car and squeezed se
verely His collar bone was broken
and his jaw was also badly damaged
and it is feared that he suffered some
internal injuries He was taken to the
t Union Pacific hospital at Denver on
the early train His parents live at
Aida Neb and were notified last even
ing by telegraph Glade has been
working for the company In this ctiy
for about sir months and was a good
conscientious workman Dr Rohr
baugh who attended him here was un
able to say how badly the man was
injured and stated that time ould

Democracy in this country is essen
tially different to Democracy in the
S old world The SocialDemocrats of
C the old world have to fight against
a monarchical form of government a
I iJ military despotism clericalism and an
S aristocracy

agtiingt a moniedocracy constituted of
rings combines trusts and monopolies
J These constitute the backbone of Republicanism

S The Republicans axe great adepts

sophistry They prate about protec
tion but they never attempt to pro
tect the American workingman from

That political principle only is sound

shall be in the interests of the many
and that many those who stand most

not the millionaires The Republicans
have never legislated in the interests
of the working classes They are in
fact the Tories of America They have
only hoodwinked the working classes
into the belief that protection encour
aged industries kept up wages and
made the toiler rich How many of
the sons of toil have realized It
True Democracy I understand to be

that taxation to fall as lightly as pos
sible on the shoulders the poor

3Free trade as far as consistent
with the wants and requirements of

of the land and that all owners shall
either mine or cultivate it

eat the industries of the country
Our worthy delegate to Congress is
undoubtedly sound in his conception
of things when he urges the opening
of the reservations on that broad prin
ciple that only bonafide settlers shall
take up the land
The millions of acres that have been
granted the railway monopolies have
been a curse and a injury to the coun
tryI
I am sir a Democrat lJ cause I find
that Democratic principles are in the
interests of the working classes If
there must be a high tariff let that
high taxation be upon the luxuries of
life and not upon the common neces
essariss of life which the working man
requires
The manufacturer always endeavors
to buy his labor in the cheapest mar
ket utterly regardless of the protec
tive tariff He has no love for his
employ ss beyoiid what he can make
out of their labor
He is anxious to grow rich and that
as rapidly as possible The protective
system helps him to do so and he uses
a great deal of diplomacy to show that
his employees will grow rich along with
him but who always fail to realize it
I do not wish to prejudice labor
against capital neither do I wish to
see the capitalist trample upon the
rights of labor
We have generally found in a free
trade country like England that a re
duced tariff or goods admitted fise of
duty has always led to a greater con
sumption of such goodsthe cheapen
ing of them and consequently to great
er trade and commerce The ship
ping and railroad companies havfa been
benefitted by it and although one line
of industry may be injured another is
created or at least Increased I am
a sir because I believe in
the greatest good to the greatest num
ber and that the greatest number
shall not be taxed for the interests
of the few
I am a Democrat because I do not
jellevte in foreign intervention but
that we should carry out the Monroe
doctrine and look afthr our own inter
nal affairs Our country is large
enough and many reforms are sadly
needed I am a Democrat because I
see emblazoned upon our Democratic
banner Liberty Equality and frater

The Gould Taxes
The long fight between the heirs of the
estate of Jay Gould and the department
of taxes and assessment over the assess
ment of the estate for 10000000 for per
sonal property has had a new feature
added to it within a few days Edwin
Gould as told in the Tribune has leased
the Barron court proprty In Tarrytown
with the avowed Intention of making that
his home for ta able purposes at least
By this move Mr Gould as one of the
executors of his fathers estate will save
a tax of 152000 which the personal prop
erty of that estate now bears in this
country He will also save an annual tax
on 100000 of 1820 which he pays on his

day My brother has leased the Barron
place so that he can be near Helen and
the rest of us and possibly because he
thinks the taxes which we are paying
are excessive and unjjt We are satisfied
to bear our share of the burdens of the

companying Governor McConnell on
his recent tour through the south
eastern portion of our young com
monwealth and for the first time in
his life coming in contact with the
Mormon people 6f course I saw them
at their best in gala attire all bent up
on giving fitting welcome to the first i
< governor that visited their borders but
the impression was purely a most
favorable and lasting one I j I
I j Whatever may be thought of their
i religious system it must be admitted
I that their economic system is far in
advance of any other In settling up
the Bear valley the people clustered
in small villages Here they built their
school houses and churches here their
families reside having all the benefits
socially and educationally of village
life while the men go forth to culti
vate their farms up and down the
valley
In their economy they have exempli
I fied the old song that Uncle San is
rich enough to give us all a farm as
I
every family has a small tract of land
to till There is no such personage
I among them as the land grabber The
land Is divided up in tracts of from five
to twenty acres and each tract is well
tilled For the most part a single
fence running the whole length of the I
township encloses the land and there I
are no crossfences Each tract is
carefully marked out and mapped but
all the land is under one fence
I I Their irrigation system is as nearly
perfect as the conditions allow Canals I
I have been taken out by the people I
and are owned and managed by the I
people at a nominal cost No foreign i
corporation has as yet taken out a
I canal in Bear Lake county Mr Had
dock the secretary of the home com
pany owning the canal told me that
the average cost of maintaining the
ditches would not exceed 15 cents an I
acre per year In the case of some
I canals the cost ran as high as 20 cents
and in others as low as 9 cents This II
I i system gives the people plenty of water
1to j irrigate their ranches at the lowest
i cost and removes them from the domi I
nance of foreign corporations In this j
1 matter they seem to have anticipated
the views of Governor McConnell on
irrigation which he took pains to ex
I plain in detail on his tour and which
merit more than a passing notice He
called attention to the vast areas of
lands in Idaho that lie unimproved
even in those parts where there is
I I plenty of water running in the canals
and asked why this state of affairs
existed and why these tracts were not
I settled up by honest settlers It is
because they are taken up in large
tracts by speculators who are trying
to grow rich by their sale after a while
and because the settler cannot pay the
exorbitant price asked for water by
the foreign companies that have got
a strong foothold in our borders Their
usual charge is 10 an acre for a water
right and 150 an acre forever after
wards each year for the use of the
water Governor McConnell denounced

said no settler could pay such rates
and make a living It was like paying
a merchant a bonus for the precious
privilege of buying goods of him and
paying him for the goods at a good
price afterwards This water right fee
was to make the settler pay for the
construction of the canal and the
yearly fee was the cost of maintaining
the canal It made millionaires of the
canal owners their agents and at
tachees and paupers of the settlers
His Idea was to pass a law
allowing the county commissioners
of any county to divide the
county into irrigation districts and
bond the property of the district to
build the canals needed The bonds
could be sold the same as municipal or
state bonds and all the necessary
money procured to build the canals at
the lowest possible cost The water
would then be owned by the people and
the water and the land would go to
gether All the people would have to
pay from year to year would be suffi
cient to keep the canals in repair
which would be very reasonable To
meet the differences of locality the
county commissioners could make such
local rules as would suit their own
people These views were received
with much favor by the people of the
I southeastern portion of the state and
will be presented to the next legisla
ture for their consideration
Bear Lake county is the sportsmans
paradise The lake is full of the finest
speckled trout and the lower lake Is
haunt of thousands of wild geese duck
and other fowl The hot springs owned
by Joe Rich are equal to any on the
coast the waters having rare healing
and medicinal qualities He is build
ing a steamer which will be ready
next summer and he will also put on a
nu nber of sail boats It Is destined to
be one of the favored haunts of the
tourist The Bear lake trout are phe
nomenal In size and remarkable for
their excellent flavor It may not be
generally credited and I write it down
at the imminent risk of being called
the boss liar of the coast but I have It
on the best authority that speckled
trout have been caught there that
tipped the scales at from 17 to 20
pounds
It is a matter to be noted that the
Mormon people now take kindly to our
public school system In nearly aU
the settlements these institutions flour
ish where the same system of instruc
tion prevails as in other parts of the
state In some cases Gentile teachers
are employed and in others Mormons
the preference being given to the lat
ter Superintendent Hix who is a
thorough scholar and a good school
man has done a good work in bring
ing the public schools into popular
favor in Bear Lake county
Taking the Mormon people as a
whole they compare very well with
people of other faiths They are a tem
perate people not a singlesaloon being
found m their villages A justice of
the peace told me that his docket
showed only two criminal cases in as
many years They are frugal indus
trious and sober Their hospitality Is
as boundless as the sea Their gospel
is that of good deeds of kindness be
nevolence courtesy They care for
their own poor and sick and but Httje
want is known in all their borders
They are ever mindful of the stranger
within their gates and treat him kindly

In the Eemerson case this morning
Charley Fork an Americanized Celestial
estial told what he knew about being
with the boys in Emersons place of
business that evening but he did not
know anything about tricks that aLe
vain and ways that are dark done
that evening as touching this matter I
Mr Fred Harris an associate of the
coterie gave his testimony being with
the number that evening as mention I
ed several times in The Herald In
cluding defendants friend W W
Hutchins who went and got the bread
and cheese with him but did not go
next time He went out alone for
twenty minutes or half an hour as
Hutchings stated but next time he did
o with Emerson to hunt for some
bottled beer in the cellar and defend
ant lifted the quilt then and lo and
behold Kenyons thousand dollars
was gone
Mr James McGarry was put on the
stand and though a little unsettled in
his nerves at times told all he knew
about the affair and in such a candid
manner that the expected revelations
and true Inwardness melted into thin
air Nothing was kept back not even
the celebrated interview between de
fendant and witness in the latters
office when he was so incensed that In
his anger he drew his pitsol and point
ing It in defendants face said You

dig It up or Ill make you Every
thing wag covered in his testimony
while on the stand in direct and cross
examination and he convinced the
jU lge jury and everybody present that
he told all he knew and that he be
lieved defendant guilty
Henry Emerson the defendant went
on the stand on his own behalf after
dinner and by interrogatories of his
Attorney Kenner his side of the mat
ter was elicited in minute detail Com
ing to the particular part of the case
on the 17th of September after getting
the bread and cheese about 1230 or 1
oclock a m He was asked Were
you at the saloon or in the cellar at
any other time than the times you
have named that evening alone
Answer not afterwards no
He detailed the deathly interview
between himself and McGarry a little
differently from the latter quoting
McGarry as saying Harry you have
got that money I says what do
you mean Jim I am surprised at
you accusing me he saysxI am go
ing to kill you right now I says
Jim kill me I have no arms do it
At that I commenced to cry and he
commenced to cry too and says
what a d fl I am We both
walked down the stairs together He
says you have that money give It
up If you dont it will be the ruina
tion of your family I says I have
been your confidential friend paid out
your official means to jurors etc
done your business He cried like a
child and put up flis gun I had a
conversation with him after this when
he said why do you shun me
Harry I accused you of taking that
money and was sorry that I did it
He was asked at the close if he knew
or had any idea who took the money
or whose it was and he declared
solemly he did not and only wished
he did
At 9 oclock Attorney McCarty for
the People spoke first on closing oc
cupying about twentyfive minutes
He was followed by J W Christian
for the defense who spoke in his best
vein for forty minutes Judge Sawyer
of Pioche Nev spoke for an hour
Attorney Kenner closing in a good
argument for Emerson Sam Thur
man closed for the prosecution with
crowds outside on the court house

not guilty but it is generally accepted
that no verdict will be reached
