down by the state supreme court in
the case of the Detroit Heating
Lighting company appellant vs Sid
ney Stevens reversing the judgment
of the lower court and granting a new
trial
trialhe plaintiff sued to recover 541832
balance of the purchase price of a
certain heater supplied The defendant
alleged the heater was defective and
claimed S37214S damages The court
below found for the defendant in the
i 1 sum of 162747 the amount with in
terest which the defendant had paid
to the plaintiff on account of the ap
paratus The defendant upon the trial

contract The opinion says that after
a contract has been recognized and
acted upon by the parties to it the

session
