The petition states that John H Ham
ilton died on or about April 19 197 in
testate that he left surviving him as
his only heIrs at law this petitioner
who Is the widow of the deceased and
Mary Hamilton his mother that he
left property ronsistins of household
goods to the value of about 150 also
5150 in money deposited in Zions Say
ings bank a gold watch and chain and
jewelry of the value of 50 and some
clothing and other effects making a I
total value of not exceeding 5375

The Hamilton case is too fresh in

holme et al vs the Franklin Fire In
surance company was begun before
Judge Cherry and a jury yesterday I
with Messrs J Ti Bowdle R B Shep
ard and C S Varian representing the
plaintiffs and Messrs Stephens <
Smith for the defendant The plain
tiffs sue to recover 1840 fire loss on
their livery stable The complaint sets
forth that the stable and its contents
were insured against fire in the de
fendant company for the sum of 200
with the agent of the company C H
Kicker but that the policy was ner
delivered also that the premium wa
paid on Aug 5 iS9o and that the build
ing ant contents were burnt in the Sep
tember following and the loss amount
ed to the sum sued for 1840
The insurance company denied in its
answer that Ricker was its agent and
also denied that it ever assumed the

The trial was proceeding when court
adjourned and further hearing went
over until Monday
FEDERAL COURT
Decree of Foreclosure Against Gas
and Electric Light Company
Judge Marshall yesterday entered a
decree against the Salt Lake Ogden
Gas Electric Light company the
ITnion Light Power company in the
foreclosure suit brought by the Farm
ers Loan Trust company
Under the decree the sale is ordered
of all the first named defendants prop
erty and rights in Ogden and Salt
Lake including the manufacturing and
distributing plants The mortgaged
4 property Is to be sold in its eiftiretv
and the defendant Is accorded no right
f of redemption The debt is due on In
terest coupons amounting 45000 due
July 1 1S97 and 45000 on coupons due
Jan 1 1SOS and a principal of 1500000
making a total Indebtedness of 1613
C10 The defendants are given 20 days
in which to pay the amount and in
case of default the whole mortgaged
property will be sold
The decree appoints S H Lewis mas

The Edwards case reached the jurj
about 230 oclock yesterday afternoon
Stenographer Pike was put on the stand
aol read from his notes a wart of the
testimony given by the defendant Miss
Edwards at her previous trial The
arguments to the jury vere then made
by Mr Putnam for the state and by i
General John Lu Taylor and Attorney
Jesse Root for the defendant Up to a
late hour the jury had not agreed and I
were locked up for the night
Miss Edwards was tried at the last
term of court for the same offense and
then the jury failed to agree seven be
ing for conviction and one for acquit
tal It looks as if there would be a
repetition of the former record in this
regard

In Case of Utah Optical Company
Against Keith et al
Mr John M Zane made the closing
argument to the jury yesterday morn
ing in the case of the Utah Optical
company against David Keith and
James Ivers in which the plaintiff sued
to recover 16000 damages for alleged
illegal eviction from a store it occupied
ivt 230 South Main street The jury af
ter some hours consultation returned
a verdict for the plaintiff assessing his
damages at SS10 Notice of appeal to
the supreme court was given
Colored Man on Trial For Burglary
The trial of Alexander Goens a col
ored man on the charge of burglar
izing the cigar factory of NIcholas
Schmieder 63 Commercial street was
begun before Judge Xorrell after the
Edwards case reached the Jury It is
alleged in the information that on Jan
14 in the night time Goens broke Into
the premises named and stole 700 ci
garsof the value of 45
Assistant County Attorney Putnam
prosecuted and Goens was defended by
Attornev C I Krebs The trial was
prccEeding when court adjourned until
today I

In the case of the Western Hotel
company vs Francis C Gilds et al the
Utah Commercial Savings bank has
filed an answer and crosscomplaint
Gilds ran a drug store in the Knuts
ford hotel and the Western Hotel com
r pany the proprietors of the Knutsford
attached Gilds property under a land
lords lien for money alleged to be due
for rent The attachment was levied
after Gilds had confessed judgment In
favor of the NeldenJudson Drug com
I pany and the bank now alleges it holds
a chattel mortgage on the stock for
51500 and prays that the same be de
J clared a first lien on the property

ten days that our visitors will be here

there are the mining men who are In i
terested in companies which have
treasury stock to sell and the operator

or for the development of which he is
seeking capital all of whom have a
practical interest in the congress
which is illustrated by the fact that
already numerous letters have been re
ceived from parties who have heard of
the congress and who desire to know
beforehand what Utah has to offer In

THE NUMBER COMING
Our first estimate was 3000 but I
begins to look now as if this was too
conservative Our plans involve the
giving of wide publicity of the congress
and Its aims throughout the east and I
am of the opinion that hundreds who
attend the Omaha exposition will ex
tend their trip to Salt Lake The en
tire state of Colorado is thoroughly
aroused on the subject and a very large
number will come from the Centennial
state alone In fact this entire Inter
mountain region will be in evidence at
the congress and from advices already
received I know that many are com
ing from the Pacific coast from Los
Angeles and Skaguay I is also ex
pected that European nations will be
represented at the congress Italy has
already signified its Intention to do so I
South American delegations will most
likely be present and Mexico and Vene
zuela will be on hand to a certainty

reserves and a redemption of notes In

February to date with no stringency
in the money market and sterling ex
change weak with the large volume
of business at clearing houses outside
New York larger than In 1S32 by 69
per cent this month and with failures
nearly 20 per cent smaller than last
year and 52 per cent smaller than in the
same month of 1892 there is not much
I visible ground for panic even If earnest
nest efforts should fall to keep peace

AVERAGE STOCK PRICES
Warlike reports come every day and
stock operators make the most of them
and yet the average of railroad stocks
is 5308 against 5320 two weks ago
today Nor have industrial operations
been percentiblv affected except where
extraordinary buying for some weeks
past has made necessary a pause for
breath so to speak or where unnatural
prices had caused a halt before the de
struction of the Maine Some decrease
In new engagements would be expect

Practically No Interruption In the
Operations of the Works
A fire broke out in the Germania
smelter at Murray at about 915 oclock
yesterday morning which for a time
looked as if it would consume the en
tire building but thanks to the very
efficient work done by the companys
fire brigade it was extinguished be
fore enough damage had been done to
cause serious interruption in the opera
ton of the works The loss is difficult I
to estimate but probably it will not
exceed 5000 and is covered by Insur I
ance
The fire originated at furnace JNo 4
by the bursting of the plug of the tuy
eres and the flames shot out towards
the elevator and were sucked up until
the entire elevator shaft appeared like
a pillar of fire and the flames quickly
spread over the roof on the north half
of the main building
The companys fire brigade composed
of the employees under the direction
of Superintendent Tucker and General
Foreman Phelan soon had the hose
playing on the blaze The men did he
roic work under grdat difficulties and
with a good deal of danger to them
selves from falling iron and timbers
and in threequarters of an hour the
conflagration was thoroughly under
control
A engine was sent down from the
Salt Lake West Side Fire department
but it arrived too late to be of any
service Had there been a north wind
blowing the whole works would In all
probability have been consumed but
fortunately the wind was from the
south and carried the flames away
from the building
The damage caused the shutting
down of furnaces Nos 6 and 7 but the
former opened up again last evening
and No 7 will be in operation again
this morning so that the Interruption
Is only trifling The company has a
welldrilled fire department which is
Inspected every week and has a water
pressure of 150 to 200 pounds at Its
command
Everybody worked with will and de
termination and great credit Is due to
11 Tucker and Mr Phelan both for
the way the fire was handled and for
the speedy resumption of work in the
damaged part of the building I
