street claims that M Levi who con
ducts a store just south of their place
Is trying to steal their thunder and filed
suit In the district court yesterday to
compel Levi to take down four glaring
banners which he has put up and which
plaintiffs ayer are detracting from the
Baron fire sale which opens this morn
Ing at 830 oclock A temporary writ
of Injunction was Issued by Judge C V
Morse last night made returnable this
morning at 10 oclock calling upon Levi
to say why he should not be compelled
to take down the signs at once
The Baron company sets forth In the
complaint that a fire broke out In the
store on Oct 28 last and that since Nov
1 It has been extensively advertising a
fire sale which Is to open this morn
Ing It Is claimed that hundreds of dol
lars were expended In this advertising

Then without advertising at all plain

The tonnage milled during the third
quarter was greater by an average of
approximately 100 tons per day than that
fur the preceding quarter
fhls Increased tonnage together with
the increased copper contents of all the
pre treated resulted In the total amounts I
of ore treated during the period having
contained approximate 1100000 pounds
more copper than did the total amount
of ore treated during the second quar i
ter The gross output of copper was I
however 1525262 pounds greater than that
for the previous quarter I

The incorporation of the Oak Creek
Orchard company a few das ago by Salt
Lake men marks the opening of one of
the largest apple and fruit growing dis
tricts In the state of Utah according to
the statements of the incorporators and
Millard COJlty within the next few years
will run a close second to the Brigham
City and Cache county orchards m point
at production
The Oak Creek company has 4SO acres
of land on the cast bench near Millard
and according to J E Ray president of
the company more than 150000 acres of
this land has been taken up In the last
eighteen months It is the purpose of
this company to send representatives to
Chicago to the land exposition tlls month
and there arrange for the development
of the land of the new company which
will bl planted to apples this fall
The movement In Millard county Is
really the blgest feature In the develoj
ment of the agricultural resources of the
state that has been planned for many
years said Mr Ray yesterday The
Sevier Land Irrigation company hab
a million dollars at Its command for de
velopment n that region and the Fill
more company has taken 25000 acres of
line bench land In the eastern part of
tlllard cOJnt which will be put under
cultivation immediate
In thIs region the precipitation for the
last four years has averaged 18 Caches
a year which Is practically what Cache
valley has averaged On this land with
out irrigation alfalfa produced crops of
75 to 110 an acre and 11 to 40 bushels
of wheat to the acre were raised last
year Another company organized b1
Des Moines men will plant 1500 acres
to apples this fall and the Fillmore Fruit
Grain Lands company will put in more
tracts to apples
Many of us who are Interested In the
land companies are putting In orchards

clerk In the waterworks departmnt to
be Incorporated In the annual report The
report Illcludes statistics since l00lQ2 In
that year there were 100 metEors In use
and at the present time there are 427
Receipts for 100102 were 103859 and lust
year they were 3li9fI while for the
year 190010 they will reach about iOooo
as a result of the Increase In water rates
made last spring The flat rate assess
ment for 1901a was i451940 while at I
the present time this amounts to 148
