CASE
fl
The third day of the trial of Clnr
enco Krnst charged with the murder
of Charles Staples on the night ot I
May 15 was marked by more Interest
Ing Incidents than occurred durlug the
two preceding days It developed yes
terday afternoon and during this
mornings session of court that the de
fense was ready to take a new tact In
the battle for their clients life and to
claim that Staples death resulted
from an unsuccessful surgical opera
tion rather than from the bullet hurl
ed from Ernsts weapon No formal
announcement of this line of defense
was made however but the ciossex
amlnntion of several of the states
witnesses indicated a tendency In this
direction
Late yesterday afternoon Clara Bur
jjoas the nurse who attended Staples
after the shooting at the General hos
pital testified as to his condition
when he was admitted to the hospit
al She said the wounded man was
In a state of collapse and in a ser
ious condition owing to excessive
drinking and tho nature of his Injur
ies After the operation on the night
of Mny tho patient began to fall and
finally died at 315 a in on the morn
ing of May 16 without regaining con
sciousness
Dr WJ Browning also testified
last evening concerning the operation
which ho said consumed ocr two
hours time The Intestines were re
moved from the body and were left
out perhaps for one hour and thirty
minutes The patient ho said ex
hibited unusual strength at the time
and the operation was performed by
Dr Pidcock and Dr Forbes
This morning Dr Pidcock was
placed In the witness box and testi
fied regarding the operation the sur
gical methods used and the time con
sumed He said about one hour and
thirty minutes were utilized in tho
operation and that the patient was
In a very weak condition when put on
the operating table It was feared
he said that the patient would die
before the operation was completed
About 15 Inches of Intestines were
taken cut and the ends joined by us
ing a Murphy button The wounded
man had tn bo given stimulants to
keep him alive and he died in less
than two hours after the operation
was completed The doctor indig
nantly repudiated the insinuation that
Staples may have died as a result of
the operation and said the wounded
man wan mortally injured before he
was taken to the operating room

Dr Forbes has resumed practice
