Operate a Telephone System Over

I SECTION 1
That the Davis County Independent
Telephone Company it Utah corpora
tion grantee Its successors and JIB
algnp tin and they err hereby granted
the franchise and right to con
atnict maintaIn and operate n public
telephone polo line and electric light
and power system for Inlercominuni
ciition by electrical delces and also
for the distribution and conveyance
of electrical energy and current
across upon and under the public
street alleyc and other nubile thor
oughfares of the said County of We
ber and to erect the necessary poles
braces crossarms wires circuits nod
other appurtenancos thereto appertain
ing Said telephone and electric light
and power system with the wfres
poles braes and other equipments
and appurtenances necessary thereto
shall be so place constructed and
maintained ns not to Interfere with
the safety or convenience of the trav
eling public or with the rights of pri
vate Individuals and shall be placed
and located as directed by tho Board
of County Commissioners
SECTION 2
Thnt Bald company Us successors
and assigns shall be subject toal
such laws ordinances rules and reg
ulations as are now III force In said
county and shall conform to nil such
reasonable rules regulations and ordi
nances as may ho hereafter enacted
by the Board of County Commission
ers of Weber County having regard
to the safety nnd convenient use and
maintenance of roads streets high
ways and bines In said county pro
vided that wherever It Is practicable
and possible for the parties concerned
to enter into reasonable and satisfac
tory arrangements the wires arc to be
placed upon tho poles of other tele
phone telegraph or light and power
companies as are IIOW constructed i
upon and along the roads highways
r lanes and alleys In said Weber County
SECTION 3
That In consideration of this fran
i chlso and In lieu and In commutation I
of any license fees upon the business
of the grantuc required by any ordi II
nance of Weber County the grantee
Its successors and assigns expressly
agree to furnloh to Weber County as I
goon as MB exchange III Weber Coun
ty Is established and In operation
such telephone equipment andex
change service within said county as
the Board of County Commissioners

out cost to the said Weber County
said fro service however not to ex
ceed at auy one lime Ten 101 reg

not Include long distance telephone
service except in Weber and Dalp
counties And by its acceptance of I

nish Weber County with telephone
equipment and service as aforesaid
SECTION 4
Thai said Weber County shall In no
way be held liable or responsible for
tiny accident or damage that may oc
cur In the construction or operation
of said pole lines wires or other ap
pliances pertaining to the system of
nald grantee That said grantee ittf
successors or assigns shall save the
county harmless from and against any
and all damages liabilities judgments
and costs on account of the construc
tion operation and maintenance of
said telephone syslwm and the accept
ance of this franchise shall be deemed
an agreement on the part of tho
grantee for Itself Its successors and
assigns that It or they will save said
county free and harmless from any
i < uch liability loss costs or expenses
arising from or out of such neglect
default or misconduct or may accrue
by reason of any accIdent or injury
which may occur by reason of the con
struction operation or maintenance of
nld poles wires or appliances under
this franchise
SKCTION 3
The rlghttt hereby granted shall ex
ist and inure to the benefit of tho
said grantee KB successors and as
signs until the iBt day of AprilA
1035 provided written acceptance of
this ordinance and all the terms and
conditions thereof bo filed by the said
Davis County Independent Telephone
Company with the County Clorl IIf
Weber County Utah within Twenty
20 days after the passage of this
ordinance
SECTION C
This ordinance shnll be iu effect on
and after the lot day of April A D
1010 said date being not less than
