State Office Must File the Applica
tion for the Appropriation of
Water of Weber River
In the case of Davis weber

Tanner slate engineer In which a
demurrer to the state ans
wer was argued on Saturday last
Judge Howell today sustained the de
murrer upholding every contention of
counsel for the canal company
It ale ears from the pleadings that
on the Oth of October last the canal
company made application for the ap
propriation of water for Irrigation
purposes from tho Weber river on a
blank furnlahed by the state engin
eers office On the 12th of October fi
the application was returned to tho II
canal company with a letter stating
that it was on the wrong blank and
requesting that It bo transcribed on
to a blank which was enclosed with
the letter and both tho original and
the transcribed application retumol
to tho state engineers office Thhi
was promptly done Then on tie 18th
day of October the strto engineer
again returned the application re
quiring certain corrections or amend
mendments to be made The statue

provides that when amendments or 0
corrections are reqplred by the state I
engineer the applicant oball he al
lowed sixty days In which to correct
find rcfllc tho application In thi
case the amendments called for wero
I made and the apllcatlon returned
within sixty days from the time the
particular corrections were called for
but more than sixty days alter the
state engineer asked to have the ap
piJcatloa transcribed on to another
I Mania and because the amended ap
1 plication was not returned within
I sixty days from the 12th of October I
i when the request to transcribe it was
made the state engineer refused to
rcfllc It and entered an order laps
ing tho application
The statute also provides that If
HIP apllcation Is returned more than
sixty days after corrections are call
ed for it must then be treated as a
I new application and the right of the
applicant would date from that time
The state engineer held that In or
der to have the application rcflled aft
er the sixty days the party must again
pay the filing fee which In this case
amounted to S20750 This the caiml
company refused to pay and the court n
holds that the state engineer has no
right to Insist pon the payment of
the fees the second time becaupo the
application was not returned within
the sixty days allowed and that in
this case the canal company Is clear
ly entitled to a writ of mandate
against the state engineer
