SUPERIOR COURT MUST DECIDE ABDUCTION CASE Order for Jury Triai Before Police Judge Will Be Rescinded TVEITMOE CONFIDENT Declares Evidence Against B Accused Electricians Is Conclusive Secretary George E. Assistant District Attorney - Bloch contended that, as abduction is an in dictable offense^ the defendants were not entitled to a Jury trial In the police court, but that the police judge eat as a committing magistrate to make a preliminary examination. The judge agreed that* this was the case, but as the defendant's attorney had left the court before this point had ber>n made the matter was deferred until today, when the order previously" made, call ing for a jury, -will be rescinded. The prosecution claims it will put on the stand the chauffeur who took the party of alleged conspirators to the home of P. H. McCarthy, 76 Collinjj wood street, on two occasions. It is also stated that an expressman has been located who will tell under oath how he had been engaged by the de fendants to meet the automobile near Forty-eighth avenue on the two night 3 when the alleged attempts to break in McCarthy's front door were made. "I do not care to discuss the matter now," said O. A. Tveltmoe. secretary of the building trades council, "because the facts in our possession proving these members of No. fi to b« cut throats and\low criminals will be pro duced in court and will be corroborated by competent and unanswerable evi dence. The bl? steamer Northwestern, which went . ashore last : March on- L.a Touche island, southeastern Alaska, and. for the saving of which little hope was enter tained, has been floated and is now at .Valdez. Dynamite was the agency , by the means of which the Northwestern was restored to the merchants marine.
