10 GREENE AND GAYNOR'S SENTENCE IS UPHELD Appeal on Finding of Court in Savannah Harbor Fraud Denied NEW ORLEANS. June 3. — The sen tence of the superiors-court in the fa mous Greene and Gaynor case. Involv ing over a Jialf million dollars fraud ia government contract work la the Savannah harbor, was affirmed today in an opinion handed down by the United States circuit court of appeals. The sentence is four years lmprison s37s,ooo. iudfres. Shelby and McCormick rend ered the opinion and Judge Pardee dis sented. Benjamin Greene, and John F. Gaynor, the defendants, appealed In 1903 on assignments of errors. Most Interest ing of these was the claim that their extradition* from Canada, a case which vc<*nt to the privy council of England before being finally tried, was illegaL They claim they were extradited upon one offense and tried upon another. Upon this point the court Bays: "It Is not unusual, nor would it be expedient or practicable for a warrant of extradition to describe the crime with all the fullness that would be re quired in an Indictment. "While extra dition and Indictment must be for the same criminal acts It does not follow that the crime must have the same name in both countries." The court held that the defendants wpre extradited for an offense for which they had been twice indicted. Keplyint? to the contention that their offense was not extraditable under the treaty, the court held first that It was . xtraditable and also that If the treaty did not on Its face allow extradition of this offense, nevertheless the parties to this treaty could have taken action <o ' make the Instrument cover the offense and that such action would liave applied to a previously com mitted offense. On the grounds that they were fugitives from justice, the court dis missed the defendants* plea for the benefit of the statute of limitation. Judge Pardee. in dissenting, went further even than upholding the plea of illegal extradition and that for -the statute of limitation. He says, quoting from a .recent court decision: "It Is better that a person escape altogether than that a judgment of conviction of an infamous crime should sustain ; u-hcre the record does not show clearly tliat there was valid trial." .He holds that the introducing of the accounts of the defendants as doc umentary evidence should not have been allowed and that the charge of the trial judge was erroneous and In any ordinary case would warrant. If not absolutely require, a -reversal. The first Indictment In this case was found Jn Savannah in December, 1599, so that today's decision comes after s»;ven years and nearly six months con tinuous fighting against the govern ment prosecution. Greene and Gaynor can now each apply for a hearing (jr go to the United States supreme court tin a writ of certiorarl. LIBERAL REGULATIONS FOR CUSTOMS SERVICE Consuls Are Informed 'of Re laxation From Present Rigid Methods WASHINGTON, June 3. — The state department mailed today to all United States consuls copies of the new cus toms regulations issued in accordance .with the te/ms of the recent tariff ar rangement with Germany. As these regulations are all In the line of relax ation from the rigid regulations Which have prevailed, their announcement is looked upon as virtually a change of policy upon the part of this govern ment toward both American Importers 4nd foreign exports. The more liberal treatment to be accorded In passing United States customs officials, it Is be lieved, \u25a0will do much 1 toward commer cially re-establishing the United States in the favorable regard of foreign na tions. While the new customs regulations abolish some of the methods whicn have been regarded as harsh, they are in no sense to be considered as a relax ation against fraud or attempts- to evade the payment of doty by under valuation.
