12 WILL TEST POWER OF RAILROAD COMMISSION southern Pacific Wants to Quash Orders by an Sr-KCIAL DISPATCH TO THE CALL HOUSTON, Tex.. July 25. — Just what jwwers the Texas railroad commission ••assesses are to be determined by an 'njunctioh suit next Tuesday at Austin y the Southern Pacific railroad asking •.hat the commission be restrained from •nforcing its recent order ie-establish ng double daily service on the Vic toria l>ranc!i of that road. A temporary restraining order has ">c«-n granted, and the case is set for rial whenever the commission is ••\u25a0eady. Its hearing will develop whether •r not the- commission lias the author iy. to order the railroads to operate 'rains, no matter whether they pay Last January the Southern Pacific 'nauguratod two tra!ns a day on the Victoria branch. The night train has •cca run at a loss, and a month ago it P— as 'discontinued. Complaint was made t residents along the line The com mission ordered the company to put back the train, at the saraft time fix ing a schedule for it. Subsequently ihe commission rescinded that portion of its order dealing with the timecard. Jt is the other feature which is now :o !>e attacked, and with it the general train ordering power of* the c-ommis :on It is expected that the commission Kill put up a stryn'g tight to retain its ••owor? in TcxasLA The contentions of pSe railroad company as outlined in the petition are that t!i«.' commission has mo further right than to s<?e that they ri::i oaoh <lay and that they afford ac commodation to passengers; that the •J-juble. daily service on the Victoria branch had boen given :v lengthened trLaJ and proven unremunerative; that ;ii<> revenue <if the road is such that it .voald bo a detriment to the people to run the service at a loss, and that when ' railroad has complied with the laws ;here 5s no right vested in a railroad •'ommission to state what* trains shall *•« run and prescribe the manner of operating them. The last three matters are constitu tional questions which will settle for \u25a0ill time the legal rights of the com mission to formulate such orders as the company is now fighting. j COURT DENIES MOTIONS BY MRS.
