10 POLICESIAX FOLBY ACQUITTED Policeman Edward Foley was ac quitted by Police Judge Shortall yester day afternoon on a • charge of assault with a deadly -weapon. He was ac cused of shooting John Ellard, a team ster, during a riot at Twenty-fourth end' Utah streets in the early morning or June 15. The evidence showed that FoJey*s club was taken from 'him and iliat he was using the butt end of his revolver, when the weapon accidentally <**p!o^ed. the bullet entering Ellard's bark. \A warrant has been out for the arrest of Michael Flannigan, a .strike breaker, for the same offense, but Flannigan has not been heard of. since tlio shooting.
