Sept. ?4. — The captain of a tugboat cannot perform a binding ceremony of marriage, according to a decision rendered .by Superior Judge Harris today in the euit for divorce brought by Katnryne Gilmore against Ardalla Gilmore. She charged deser tion. Questions by the judge elicited the information that the alleged mar riage had been performed at sea, off San Diego, in July, 1599. Plaintiff said Gilmore told her that he bad been divorced and that six months must elapse before he could be legally married on land. If she could overcome her fear of the ocean long enough to sail only a few miles from the shore, he said, they could be mar ried, despite the laws of "state and na tion. .Her consent was • won and a diminutive tugboat was chartered. Radzwiil was appointed ad ministrator of the estate and by law inherited one-third of it as an t\e\r.
