12 APPROVES PLAN TO ABANDON BUILDINGS Joint Supervisors' Commit tee Acts on Hospital and Almshouse TO ABOLISH STAFFS Frank Schmitz and Wife Among Employes Who Will Lose Jobs The joint comnjittc-e on judiciary, health, finance" and buildings of the board of supervisors recommended yes terday the abandonment of the city and county hospital and the almshouse in accordance with the resolution pre sented by a special committee at last Monday's meeting of the board. The recommendation; carried with it : the abolishing of the entire forces of 'both institutions, and as a result more I than 100 employes will lose their posi tions. Included in these are Frank ;•; • Schmitz. superintendent of the alms-. • house, and his wife, who is matron of the same institution. The committee directed the prepara tion of resolutions ordering the imme diate transfer of the inmates of alms house building No. 2 to the Ingleside model camp. «o that the chronic cases of the hospital can be transferred to the building vacated. The acute and non surgical cases will be placed in private hospitals, and President Ophuls of the health board was requested to arrange Jot the lease of Mary's Help hospital, \u25a0which will be completed in two months, for the accommodation of the sick poor. It is expected that the, transfer of the remainder of the almshouse inmates to the new relief home will be accom plished on December 15. The q»iei«tlon of the destruction of the hospital and almshouse buildings was left for future consideration, but that course has been decided upon already. The unexpended balances in the appropriations of both Institutions will be transferred for use In the plan outlined. Supervisor Sullivan renewed his ! objections to the abandonment and ulti • mate destruction of the hospital, claim \u25a0 Ing that the bubonic plague scare was . unwarranted. F. VT. Dohrmann of the relief corpor ation said that Dr. Blue of the United , States marine hospital had decreed that j a new hospital building was an^abso- lute necessity from a sanitary stand j point, and his ruling \u25a0was indorsed by ; the medical profession: ' Dr. Blue escorted a committee of •women from the county hospital auxil iary association, consisting of Mrs. Henry Payot, Mrs. C. W. Slack and Mrs. Krnest Simpson, to the county hospital and new isolation hospital yesterday, in order that they might become acquaint ed with a.ctual conditions in the insti tutions. SENATOR BORAH TALKS ABOUT RIPARIAN LAW Makes Interesting Argument Before Federal Appeal Court United Slate? Senator Borah of Ida •ho argued yesterday before the circuit court of appeals on behalf of the plain tiff in the case of Henry Schodde against Twin Falls Land and "Water company of Idaho. He appeared for Schodde, who appealed from an ad verse decision of District Judge Beatly of the same state. According to the V.'rUf on file Schodde sued the defend iint for $5-6.550 damages done to 42 « .Ticres of land. Schodde had several \u25a0water wheels in Spake river turned by the current by which means he irri gated his lands. Nine miles down the river the defendant built a dam which checked the flow of the current and Hopped Schodde's wheels from turning. Judge Beatty sustained the demurrer of the defendant and threw the case out of court, remarking at the same time that Schodde was demanding dam ages at the rate of $130 p*r acre, which was far more than the full market value of any of the lands In the coun .ty. and that Schodde had viio vested rJght in the water that would justify him in retarding the development of the country. Senator Borah argued yesterday that, ft being established that a riparian owner had a right to use water from a stream for the purpose of irrigating hJs crops, he was entitled to the aid of the rourt to prevent interference with that right. He declared it to be a well es tablished rule that the riparian owner «-ou!d not, by the construction of a dam. back up water so a* to interfere with the works of an upper owner by means of which he had appropriated \u25a0water for a beneficial use. The speaker contended also that It was Immaterial whether the user took the water for irrigation or mechanical purposes, he being entitled to have the stream re main in its natural condition, and others could not lawfully Interfere with the flow of the stream without being lia ble. Williamson, s. well known member o( the San Francisco bar. has committed willful and deliberate perjury, and that he Is a wretched pettifogger; are made in an affidavit Attorney Stephen Costello filed in Judge Graham's court yesterday. Coetello suggests that \u25a0Wil liamson's conduct be Investigated by the grand Jury. The attack arises out of the c&ae in which John Mitchell obtained a ver dict for $5,000 damage* against the California and Oregon Coast steamship company as compensation tor the death of Mitchell's minor son. Williamson, who represented the defendant cor poration, applied for a new. trial, but as the Btatutory SO days " had " expired he had to ask . relief, and In >hls affi davit stated that during, May, 1907,, he was engaged In trying a case In the superior court of ,Laasen oounty and had overlooked, filing 'of the applica tion.
