12 TIREY L. FORD'S TRIAL TO BE RESUMED MONDAY Court Action in Such Cases Legal During Special Holidays PROSECUTION IS SAFE . • -i No Concern Regarding the -.- . Constitutionality of XT T New Law • The trial of Tlrey L. Ford will be resumed on Monday. Lawyers who 4iav« looked into the law passed at the special session of the legislature are satisfied that, there is no risk in per forming all court functions in causes pot basod upon contracts for the pay ment of money. Even if the law which allows of the transaction of court business on special holidays is declared unconstitutional, such a de cision will not affect cases that have been tried under authority of that law. This apparent paradox Is thus explained by lawyers: The new law permits the governor to declare "special holidays" and per mits the trial of causes on those days. Under the laws of California no such days as "special holidays" were pre viously known. "Special holidays" were, constituted for the express purpose of permitting the conduct of public busi ness at times when the banks needed protection by holiday. If the supreme, court declares the act to be unconsti tutional the effect will be that the '••special holidays" which the governor lias declared under the act will not, in point of fact, have been special holi days or holidays of any kind. They will have bepn legal days, and all acts of the courts on those days will of course -have been valid. t On the other hand, if the law be d.e ared constitutional, that will also mean the upholding of all acts of the courts on "special holidays." The net effect of the situation. In the opinion oi the lawyers who have looked care fully into the question, is that trials may b<? conducted on and after Monday 5n perfect unconcern as to the consti tutionality or unconstitutionally of the new law. If th.c defense in the Ford or. any other trial should raise the point the prosecution would not be hampered by it. The original intention was to re- teumo the Ford trial Friday, but a dispatch from Sacramento last night announced that Governor Gillett would not declare special holidays until Mon day. .The intervening days will be legal holidays. The dispatch from Sacra mento said: Governor Gillett Raid that he would continue 'to- call regular holidays from now until nest Saturday night. At that time he will issue a proclamation declaring a series of special holl jdays, provided for by the new act passed by the !<tis!ature last week, the series to begin Mon day. December 2. The governor could proclaim Friday and Saturday special holidays, but he hsg decided not to rto t-o. He said today that if special holidays were declared Friday and Saturday Jt might force many litUrints and persons having cases in court to pet their oases into shape in a hurried end unsatisfactory manner. STATE BANK BOARD IS CONFERRING ON THE LAW Commission Plans to Antici pate Work of New Committee WANTS MORE POWER Inability to Enforce Its Rulings Deplored by Members The members of the bank commis sion met yesterday and <vnferred .with Attorney General Webb on matters of legislation. Another meeting will be held today, at which steps will be taken to correct the defects in Califor nia banking laws. The commission has In view certain modifications, of the law to safeguard more strictly the In terests of depositors. -To some degree the commission will in this way antici pate the work of the special legislative investigation committee. Members of the commission say that in dealing with the banks the greatest handicap has been its lack of authority to en force rulings. It ' will ask the next legislature to strengthen its hands in this respect and give it a power simi lar to that exercised by the government over national banks. A general improvement •was reported yesterday in the financial situation. Business has naturally fallen off, and with tills condition the demand for coin has declined. At the' same time the available supply of money is daily growing and automatically, it is be lieved, conditions will adjust them selves and the banks return to a nor mal basis. Eight more applicants appeared at the subtreasuary yesterday and sub scribed for the 3 per cent certificates to the amount of $33,000. In all 60 appli cations have been fibsd for a total of 1144,250. The directors of the California safe deposit company report that • steady progress Is being made. Many de positors have signed the agreement which provides for the withdrawal of money in Installments. This agree ment provides that depositors may draw 5 per cent of the deposits in 10 days after the bank resumes, another 5 per cent in 30 days, 15 per cent in three months, another 15 per cent In six months from the date of the reopening, 10 per cent In nine months and 40 per cent In one year. It is further provided that the deposits shall continue to draw interest at the rate of 4 per cent until withdrawn. C. H. Imhoff has arrived from New York and is assisting in the adjustment of the bank's affairs. The sum of 5410,000 was paid out yesterday by the subtreasury to local banks on transfer from New York. GRINDLEY'S ACCUSER TO FACE COURT MARTIAL Perjury and Accepting Gifts of Contractor Charges Against Jones "Perjury" and "accepting a gift of a horse and buggy from a contractor" are the charges that were brought yester day against Lieutenant Thomas A. Jones, U. S. A., who Is to be tried be fore a court martial at the Presidio next Tuesday. ___ ';'.'. ,0 There are several other charges of a less grave nature. Jones' case is a pe culiar one. He preferred charges against Sergeant W. C. Grlndley for discrepancies in the forage accounts In the quartermaster's department at Fort Baker while he was quartermaster at that post. Grindley was tried '• and acquitted. Jones was the chief witness at the trial of Grindley. The case has caused much interest in army circles. At the coming trial Captain Solomon Avery Jr. will act as judge advocate. Lieutenant Jones is an officer of the Sixty-first company Coast artillery, and still retains his position as quarter master at Fort Baker. He entered the army as a private in the Thirty-first coast artillery December 34, 1899, and was promoted to lieutenant February 2, 1901. He has been stationed at Fort Baker for two years. YOUTH PAWNS $475 WORTH OF STOLEN GOODS FOR $5 Richard Ashe, Aged 17, Admits Hav ing Robbed Residence of F. Schell in Oak Street The burglar who entered the resi dence of F. Schell, 2015 Oak street, last Friday afternoon during the absence of the family and stole Jewelry and cloth ing valued at $475 was arrested at 1 o'clock yesterday morning by Detective J. J. Dow. He is Richard J. Ashe. 17 years of age, who lives with his father, a bank messenger, at 2019 Oak street. The boy admitted that he had . com mitted the burglary and that he had pawned the Jewelry and clothing at J. Sterns* Golden Gate avenue loan of fice Saturday morning, getting $5. He said that he had been gambling at the poolrooms and wanted money to bet on the races. The jewelry and clothing were recovered by Detectives Harper and Proll.
