12 COLLINS CONTINUES FIGHT FOR RELEASE Applies to Supreme Court for Writ Compelling Hearing for Arguing Motion Tn a further effort to peaceably break out of San Quentin penitentiary, George O. Collins, now serving a term on a charge of perjury^ yesterday applied to the supreme court for an alternate writ of mandamaus, compelling the superior court to set a date for a hearing of a motion to set aside final process, as issued by that c*ourt. The motion for the writ alleges that the superior court has unnecessarily and arbitrarily postponed the hearing of the motion from week to week, maintaining that the appellant was not represented by counsel notwithstanding the fact that a date has previously been fot. The lower court maintains that Collins, being convicted, can not appear on his own behalf. Collins holds, in his petition, that there is no such thing as "outlawry" and that if there it would not be con stitutional. To maintain this conten tion he quotes Blackstone, the state constitution axid the penal code, as amended in 1903. A similar application, filed in the district court of appeal, was denied March 1, 1910. Tracer told him that if he was "hard up" he would pet him a bed and something to eat. Carr demanded the coin and called Tr&eey an offensive name. Tracey told him he was a po liceman and showed him his star, whereupon Carr struck him on the face. Carr was arrested for battery and beg erins and yesterday Police Judge Short ill gave him CO days on each charge. COUSINS OBJECT TO THE COST OF FUNERAL The expenditure of $688 by Marie Louise Harris, widow of George Harris, for the cost of his burial, was objected to as excessive in Judge Graham's >.ourt yesterday by the representative 3f two cousins living in New York, who receive $10,000 each from the estate of Harris. Mrs. Harris, to whom the remainder of the $50,000 estate was willed, was surprised that the distant relatives should presume to question her gtod faith. Judge Graham allowed tlie expenditure.
