Mrs. Smith, who was sleeping up stairs with her baby. Katherine, was .. awakened about 2 o'clock by the child , robbing and coughing. The room was filled with smoke and she found her . self scarcely able to breathe. With difficulty she sroped her way to the top of the stairway and discovered that flames were forcing their way through the floor from the basement below. Judge Mo gan will decide today whether the order Shall be made permanent. TWO JUDGES NAMED q FOR HIGHER COURT Chipman and Allen Will Sit in Contra Costa Case The case of the Contra Costa water company against the city of Oakland is to be resubmitted to the supreme court, according to a stipulation filed with that tribunal yesterday. The stipulation is to the effect that Justices F. W. Henshaw and H. A. Mcl- Yin decline to participate in the de cision of the case, deeming themselves disqualified. The remaining justices also being unable to agree upon a de ciVion of the cause, the submission is ordered vacated and a resubmission of •the cause to the court in bank ordered. N. P. Chipman, presiding justice of tlie appellate court of the third district, and M. T. Allen, presiding justice of the appellate court of the second district, will sit in the places of Justices Hen- Ehavr and Melvin. UNIVERSITY TO BUILD TWO FARM BUILDINGS Plans Drawn for Completion of Needed Structures BERKELEY. June ii.—X laboratory claesroom and oflice building and an addition to the ivork shop will be built at university farm at Davis. Secretary Henderson has announced that plans' for the structures have been completed and .bids shortly will be called for. In' the office building will be the headquarters of the farm manager, while the annex to the work shop will contain a forgeroom, carpenter and work shop. It also wIH be used for the instruc tion of boys in the agricultural high echool, and for the instruction of stu dents of the college of agriculture of the university. June 13. — The decision of Judge Wellborn of Los Angeles holding the patent on the processing of raisins before seeding as invalid affects a dozen or more cases brought by the consoli dated against independent seeders. The late Colonel Forsyth obtained the process patent some 15 years ago,, but this is the first time it has been 6ub-. jected to a court test. WILSON WANTS 40 MORE POLICEMEN Police Superintendent in Budget Estimate Proposes Big In* crease for New District OAKLAND, June 13. — Superintendent of Police Adelbert Wilson, in his police budget estimate which he submitted to City Auditor Gross today, asked that' the appropriation for the department in next year's budget be $252,405. This contemplates an increase of $77,220 over the appropriation for the present year,* which was |175,155. although the de partment's estimate of a year ago was $195,947. In the detailed report of his esti mated expenses for the coming year Chief Wilson asks for 548,000 to cover the salaries of 40 additional patrolmen. This addition to the force has not been made yet, but the superintendent will seek the approval of the. city fathers when the work of compiling next year's budget is taken up. He said today that most of the new men, if their en listment is authorized, will be detailed to the annexed districts, where there has been an insistent demand, for bet ter police protection. Among the other items which were included in the estimate were the cost of two autos for the police, one to hold seven passengers and the other . five, and a new electric patrol wagon. Haydel Arrives Too Late OAKLAND, j June 13. — Relatives of Abner J.^Taydel. \vho harangued the passing throng at the corner of Broad way and Twelfth street a few nights ago until a policeman arrested him on suspicion of insanity and who was found to have In his possession $200 in currency and a bank book: showing a deposit of $23,000, have wired Superin tendent of Police Wilson to hold the man until they send for him. Haydel was released several days ago by the lunacy commission on the ground that he was merely a religious fanatic and not insane, and the police are ignorant of his present where-, abouts. . R.Kleis, proprietor of the Pacific ice cream company, who^is accused by Ed wards of stealing trade, : name, cus tomers and business. ' Taking of testi mony;inithe case began today before Judge Harris. . Edwards got an Injunction stopping Kleis temporarily from using the name of the company. He said that Kleis and his wife, went to work for him, secured%is list of customers and then opened an ice cream parlor of his own, sending notice, to the old customers that' the Pacific ice cream company had moved its place of business. Kleis testified today. that he had as much right to the narfie and business as Harris, as he 7 was' interested ln busi ness with him. \u25a0\u0084 : BURGLARS BREAK INTO PETER F.
