The etate department of engineering, in the name of the .people of the State of California, may purchase, receive by donation or dedication, or lease -any right of way, rock quarry or land necessary or proper for tbe construction, use or maintenance of said state highway. and shall pro- ceed. If necessary, to condemn under the pro- visions of the Code of Civil Procedure relating to such proceedings any necessary or proper right of way, rock quarry, or land. The department of engineering shall have full power and authority to purchase all supplies,, material, machinery and to do all other things necessary or proper in the construction ' and maintenance of said state high- way. With the ' exception ; of those public high- ways which have been permanently.
