2 ASKS COURT TO OUST RIVAL Supplanted in the affections of Alfred Marks, proprietor of the State Directory and publisher of the Mer cantile Guide, whom she is suing for divorce, Mrs. Mildred Marks appeared today before Judge Graham to secure an order of court ousting her rival, Miss Edna Burris, from the Marks residence,'l7sl Page street. Marks' attorney objected by saying that Miss Burris Is not at the Page street house. Attorney Ernest Pag nuelo, for the wife, was granted per mission by Judge Graham to file an affidavit showing that Miss Burris had usTirped Mrs. Marks' place and. until recently, at least, had been acting as housekeeper for the defendant hus band. "Miss Burris is an old friend of the family," declared Mrs. Marks. "1 trusted her and welcomed her to our home when we were living on Ashbury Heights, and later when we moved to Page street she was a frecfuent caller. "My suspicions were not aroused until I heard that my husband was lavishing gifts and entertainment on Miss Burris, and were not confirmed until I found a letter addressed to 'Dear Al,' and signed 'Edna.'" Here Is Doctor's Affidavit State of California, city and county of San Francisco —ss. O. S. Essenson, being first duly sworn, on oath, deposes and says - : That he is a and surgeon and has been such for a period of 14 years; that he has been engaged in the practice of his said profes sion in the city and county of San Francisco, state of California; that during the month of June or July, 1913, affiant met one Dr. O. C. Joslen; that said Joslen informed affiant that he, said Joslen, was the owner of several medical offices in said city and county of San Francisco; that there was a position vacant in one of said offices, and that affiant might have said position if he so desired, and which said vacant position was that of physician; that thereupon affiant accepted said position, and was thereupon directed by said Joslen to report to the Cook Medical company, situated at No. 85 Third street, in said city and county of San Francisco; that affiant did report to said Cook Medical company as aforesaid, and did then and there enter upon his duties as a physician for said company; that affiant was curious to know the manner in which said institutions were conducted and operated, and for that reason he accepted said position with said company, and while so employed by said company at said location affiant performed several minor operations during a period of three days; that at the termination of said third day affiant became disg»sted with the affairs and conditions in said institution, and for that reason affiant then and there terminated his said 'employment, and that then and there affiant was paid for services rendered by him to said institution by the said Joslen, and his said employment did then and there forever cease. Affiant further says that he has not since said time been con nected in any manner whatsoever with any institution of a like char acter and ever since has, and now is, conducting his profession as such physician and surgeon alone and in a legitimate manner, and affiant regrets his connection with the said institution owned, operated and maintained by said Joslen. In his message to Secretary Ralney, Rolph says: "Our case looks promising. Senator Pittman of Nevada is a general we can be proud of. Senator Perkins is defending us gallantly. I think we will have enough votes to pass the bill tomorrow." It 'it. said that the real test of strength will come tomorrow after noon in the senate, when the oppo nents of the bill will seek to Intro duce an amendment and refer the bill back to the house. The city'a forces will be marshaled to prevent this move. Rolph also said in bis telegram that he would go to New York Sunday to investigate the Metropolitan opera house situation, with a view to apply ing whatever information he can to the solution of the local problem. WILL VOTE TOMORROW WASHINGTON, Dec. s.—After a week of strenuous debate, during which the friends and opponents of the Hetch Hetchy have exhausted their last bit of ammunition in the fight, the ora tory is drawing to a close rapidly and a vote will be taken before adjourn ment tomorrow. . Interest ln the closing hours of the quarterless fight centered in the slap in the face administered to Theodors A. Bell, the opposition leader, and the astounding change in front made by Congressman Denver 8. Church of .California, which proved a boomerang for Senator John D. Works, who ex ploded what he thought was his most powerful mine in a long letter from the California congressman. The meat of Church's letter is that he had been misled by the agreement made between representatives of the Turlock-Modesto lrrigationists and the city of Ssn Francisco, and that he is now satisfied that the passage of the bill would mean much damage to the people of his district. Senator Works added a paragraph of oily adjectives puffing Church's character. Undoubtedly the motives of Con gressman Church in his "turncoat" Stunt were questioned by many sena tors. WOMAN SCREAMS; BURGLARS CAUGHT Miss Belle Bellsvue, a guest of the Hotel Elite, Turk and Taylor streets, was suddenly awakened from her sleep at 4 o'clock this morning by burglars, -who were attempting to force an entrance of her room. The young woman Immediately rushed to the open window and screamed for help. Her screams at tracted the attention of Policemen Whalen and Harry Walsh. They both rushed to her assistance. Hiding in the hallway of the hotel they found two men, who gave their names as Paul Oalvln and Jack La* velle. The policemen placed both un der arrest on charges of burglary. CHARGED WITH LARCENY Lawrence Waters, a photograph solicitor, was arrested at San Pablo avenue and Fifty-ninth street lata yesterday afternoon and charged with petty larceny.
