Yesterday, in chambers, Judge El- | liott made u decision in reference tx> j the irrigation law which is of great interest to all farmers nnd ditch f owners. 11. N. Ilaynes, the irrigation referee for water district No. 3, which \ is the largest irrigation district in the {State, having tiled his report and record of testiinonv, certain parties, by their counsel, requested the Judge to make the necessary rules to bring all parties interested into court and proceed to adjudicate on the priority of right to water of the several ditch es in the district. Judge Elliott re fused to make anv such rules, hold ing that the statute was fatally de tective, jn that it did not. make any provisions to bring parties into court to be heard. This decision, if correct, practically makes the irrigation act a nullity, and acts of the referees useless and all the expenses incurred by farmers and ditch owners iu offer iug testimony without effect. Ac cording to this ruling the priority of right to water can only be determin ed by ordinary judiciul proceedings, as if no irrigation law had been enact ed. It is probable that the correct ness of this ruling will be tested by proceedings in mandamus in the su preme court, compelling Judge Elli ott to adjudicate questions of priori ty as intended by the legislature. If the supreme court sustain Judge El liott, of course the writ of mandamus will be denied.—[Denver Tribune. Whatever else may 'be doubtful about the intention of the authors ol our tariff laws, they undoubtedly meant to place on the free list all materials used in the manufacture of paper. ll happened that pulp of wood, which is by far the mo.it im portant elcnm ut the manufacture of paper used bv the daily and week ly press of the country, was not spe cifically and by name exempted from duty. Under a Treasury decision which held that this verbal omission was fatal to the free admission of wood pulp, a few manufacture s of that article have been able to impose an cxliorbitaut tax on the general body of paper-makers, by whom it is of course shifted on the coiiMimers, the newspaper publishers of the country, ami the burden falls with special hardship on publishers out side of the great cities—we, conse quently, being impoverished so that a handful of monopolists may grow rich. The most powerful champion of these monopolists is Representa tive Garfield. Were his opposition to the bill withdrawn, the restora tion of wood pulp to the free list, where it belongs, would be accom plished in a few days. While his op position continues the monopolist» are secure. Can Mr. Garfield afford to continue his support of a most odious and oppressive tax which brings in no revenue to the govern ment, but which interferes very de cidedly with the dissemination of knowledge among flic people ?—[Ex.
