ing delivered his opinion on the prayer from the
hack men, asking that th railroad company be en
joined (rum using so much of the road as Interferes
with the hack men and omnibus drivers plying
their regular vocation at the railroad depot.
He decided that the suit waa properly Instituted)
although the Interests or the complainants are dis
tinct, the suit Involied the establishment or a
right common to allt and further, the road as laid
was In violation of the charter of the eompany,
and a nulsanoe. interfering with the regular prose
cution of the busluess uf the complainants, and
that It was not competent for either the Secretary
of the Interior or Commissioner of Public Build
ings to authorlt the erection of a nuisance. He
ordered an Injunction to issue, (the complainants
siting the usual bond to prosecute the suit.) pro
