obedience to this last mentioned order, he

them, and agatn applied to tbe court. A
rule to ahow cause why he ahould not bo
proceeded agatnst, aa lor a contempt, waa
then mado ngalnst Kavanangh and aerred
upon liltn. On the Sd of April, 1860, ho ap
peared to ahow cause and also moved tbe
court to dismiss all proceedings against him.
The court denied hla motion, and oa the
20th of April, 1689, made and entered an
order requiring eald Kavanaugh to deliver
to said Ilorr all tbe aald property then In
bis possession, which was covered by eald
deed of trust, and to pay to him the pro
ceed derived from the sale of the residue,
and that ho bo committed by tba marshAl to
tho jail of tho District until eald order
should be complied with.
From this order, tho defendant. Kavan
au(b, appealed to the general term of tbe
coart.
The case was argued by Mr. Totten, and
Mr. Hankie submitted the cause without ar
gument, and the court held It under ad lis-
