A, number of cases arising under thla act
are now on argument before the United
State Supreme Conrt on writ of error from
the lower count, two cases in wuicoa.
T. F. Garnett le claimant, oue ta relation to
Teal and the other to personal property,
from the Supreme Court of thla District,
e,nd one In which Wm. NCoYelgh Is claim
nt, from the circuit courTfor the District of
Virginia, are argued together. In each of
these cases the proceedings below resulted
In decree of forfeiture) and In the case of
McVeigh by default. It Is contended here
that there were fatal irregularities In the
proceedings below, and that tho decrcea
ahould be reversed for that cause i bub the
principal question presented Is that of the
constitutionality of the act) tho claim
ants oontendlng that the proceeding author
lied by It. is one to punish treason, and that
each was the Intent, Is plain from the title
of the act, which recite the fact. Delog
each, it Is la violation of the Constitution, 1;
that It proscribes other than the conttltu
tlonal mode of trial for that offeneo.
Among the plainest requirements of the
Constitution arc, that "the trial of all
crimes, ercept In cases of Impeachment,
shill be by Jury, on Indictment by a grand
Jury" and that there shall be "no convic
tion unless on the testimony of two wit
neises to the same overt act, or on confession
In open court."
The punishment of treason or other crimo
by proceedings in rim , as In these, cases
under the act In question, and by default, Is
at war with all these provisions, and Is un
known to the Constitution. The Informa
tion filed under the act might serve as a
mode of. Identifying the property of tho
offender and enforcing Us forfeiture, after
conviction upon trial by Jury of the charge,
but could not precede It. Otherwise It might
happen that a party whose estate haa been
condemned by this proceedings (n rem. might
afterwards, upon Indictment and trial for
the same offence, be found Innocent.
The Attorney Qenneral contends that the
law Is constitutional, and that In the exer
cise of Its municipal and sovereign rights,
Congress had the power to prohibit, under
penalties, tho offences named In the act,
and to proTlde that these penalties should
be enforced by proceedings to rtnu The
questions are argned at great length by
eminent counsel, and tho decision will be
one of great Importance to the people, par
ticularly of the Southern Btetes. Other
similar case from different eectlons will
follow In course of argument.
