Tun election returns from the Sta'c of New Hampshire are very cheering to every true friend of the Union and sincere lover of his country. They indicate a most de cisive i ictory for the Itepublican party, and prove that the old Granite State is firmer thsn ever in the defense of trutu, right and justice. Under the cirru:n.tanccs this KepuUican victory conveys to the Dcm ccr&tic part- a significant rebuke, and as sures Item that the country is not yet pre pared to adopt its heresies or countenance its flagitious sins. "When the ex-Confederate House was organized, it was promised by its friends that the fruit of statesmanship and reform would soon relieve the country from its embarrassed condition. The result has proved the shadowy basis on which these promises were made, and that to detract attention from their want of true states manship the Opposition is compelled to raise' a great hue and cry over accidentally discovered corruption. Of course, the ex posure of malversation by officials of high or low degree is a duty, but it is not the only duty devolving upon the House, nor will it satisfy the people that their interests are in safe hands. Let us have some action on the currency question, for example, or a frank admission that the laws enacted by the Republican majority of the list Con gress on this subject arc sufficient for the emergencies of the occasion. IHZ LA.W-MAKEBS ABE THE LAW BREAKERS. The House of Representatives yesterday in its action upon the case or the contuma cious witness, Mr. Hallct Kilbourn, ap pears to have been oblivious of ticexist cnle oT"the R:sed Statutes. Section 102 of chapter seven provides that a witness who "refuses to answer any question perti " nent to the question under inqui- shall "be deemed guilty of a misdemeanor, "punishable by a fine of not more than ' $1,C00 nor less than $100, and imprison- ment in a common jail for not less than ' ' one month nor more than twelve months. ' ' Mr. Kilbourn has repeatedly offered to answer the questions' propounded and to produce his books and papers if any re sponsible person would make affidavit that Jm business affected the Government of the United States. Otherwise the questions lack pertinency, being an unwarrantable and impertinent interference in the private affaire of the citizen and a direct infringe ment of the principles laid down in the "Bill of Rights." The amdavit was not .. produced. No evidence nor scarcely a decent pretense was made that the commit tee had reason to suspect that Mr. Kilbourn's books would aid it in the ex posure of any fraud upon the Gjvernmcnt He therefore stood upon his reserved rights, and refused to respond to the questions. He then came into the contempt of the House, as the committee calls it, but the above section calls it a misdemeanor, and states how it shall be punishable, what shall be the penalty. Then the law goes on to describe the procedure in the House against which the misdemeanor has been committed. It is as follows "Sec. 101. Whenever a witness, summoned as mentioned in section 102, falls to testlfr, awl the facts arc reported to cither House, the President of the Senate or the Speller or the House, as the case may le, shall certify the fact under the teal of the Senate or House to the District Attorney for the District of Co lumbia, whose duty it shall be to brine; the matter before the jrand jury for their action." Why did not the House pursue the course laid down in the Revised Statutes "When did one House acquire the power to abrogate a law passed for its guidmce in such cases by the two Houses in Con gress assembled? The law of Congress docs not confer the power upon the House to try a recusant witness for misdemeanor and remand him to jail for punishment. On the contrary, the section 104 quoted above (and which, by the 1133-, was printed in our news columns yesterday morning, for the especial edification or Jlr. Glover and his committee) is mandatory upon the House against which a witness is recusint. It leaves jes'discretion with the House whateref in the matter. The presiding -g&ixr "ihall certify the fact under the seal," dec., to the District Attorney of the District of Columbia, who shall bring the case before the grand jury- What for? "Why, for the purpose of indicting and trying him for the misdemeanor above named, and if found guilty, that the Court my sentence to fine and imprisonment, as provided in the statute. BEH JAMS' HILL The great gun of the Southern wins of jAe Democratic party is 3Ir. Hill, of Qforgia. His philosophical calmness on allNvxoiions, his accurate knowledge of public affairs, his incut judicious defenses of Southern policy and opinion, his courage and eloquence, fit him for leadership, and we anticipate his speeches with great pleasure." It is a great pity that he is not better appreciated at home. A little piper and a little editor way down in Savannah is advising him to hold back, actually putting a bit In his mouth, thinkins to ho'd liim. Probably all this editor Is or ever expects to be is due to Mr. Hill's kind re gard, and now he wishes to deprive his patroD, by keeping him silent, of extend ing .his fame at tbcNorth where he is held in just uliaato It is stated that Mr. Hill will deliver, upon the first opportunity, an elaborate defense of the Confederacy and or secession. The Savannah Morning Kcwt, in view of this fact, says, with, re freshing coolneas "The acts of those irlo cut their fortunes with the Confederacy nied no asolocv. nor 'docs the Lost Cause need a special defender. Even 11 such were the can-, the preicnt is not a fitting opportunity." Now, the ITcui a mistaken. An apology is needed, and the Lost Cause needs a special defender, and Hr. Hill is just the right sort of man for the occasion, and he will perform his duty c.n amore. He has sense enough to know that the true animut of Southern Democracy is perfectly well understood at the North, and that its ulte rior purposes cannot be concealed under a cloak cut in any fashion of hypocrisy. According to the Site Mr. Hill is all right, and every thing he says is true, but at this time he is impolitic. The excitement that followed Mr. Hill's impolitic utterances may have been CTatifrlnc; to his vanity, but it was not at all creditable to his judgment. The blunder was the-more inexcusable on the part .of Mr. HIU for the reason that It was unpro voked and unnecessary." We like, to see, as a theatrical show only, impersonations of Uriah Heap and Amini dab Sleek: The editor of the Jfiict is a great artist. lie assumes the rolt of hu mility and hypocrisy naturally, and effect ively, nis picture of penitence is truly pathetic, and though we know it is all a sham, still we can scarcely keep from shed ding a real tear. With how much docility Jlr. Hill will receive the lesson remains to be seen. This amiable Southern scribe goes on to declare himself further in the following excerpts: "We do not desire, however, to be consid ered as arraying oursehes with those who dis approve of cither the matter or the method of Mr. Hlil's memorable reply to Mr. Blaine. There it is in a nutshell. The predomi nant spirit of the South its unconqucred hostility to the Union of these States, its rank treason, are all admitted, applauded and defended, and the only giurd on the lips of the South is that of pure policy. Is stronger proof wanted than this afforded by the Savannah 2Ccxat editor? Will all shilly-shally, dilly-dally Republicans make a note of this fact? EDITOEIAL POSTS CEIPr.
