Certainly it is best that he should be tried by civil court if tried at ail, but we think that under ail the circumstances it would be much letter that he should not be tried i<t ail thau by civil court. I'rt sidont Johnson is reported as say ing in regard to the case that ho wish es to have it settled judicially what i» treason and what isn't It is very natu* utl and proper that ho should wish this, but to our tninds it is perfectly obvious, that, whatever the merits or demerits of Jeff Davis's case may be, there can not be the slightest cbanoe of a decision against him. When wt consider how entirely every commun!» ty is divided in opinion as to him and Iiis course of conduct and tho nature of the acts with which he is charged, wo do not. soe how any man can for % moment doubt the utter impossibility of obtaining a jury of twelve men in the common and established mode of ob taining juries, some individual of which and even several who will not refuse to unite in a verdict of treason against him. We say again and again that! hit conviction upon that oharge by it jury got up in the ordinary way is a tiling wholly out of the question, ftnd we be pay add, that 'if any ex traordinary way ba restored to and a conviction thus brought about, such a conviction Can do no conceivable trood but must, on the contrary, be deplorable in its iniluonoes upon tbe public mind andheart verywhere North and South and over the ocean. We do not sue that there is the least occasion or even room foi argument upon the subject. li the authorities at Washington with the question settled what is and what is not treason, they surely err greatly in making the conviction or non conviction of .Jeff Davis by a civil court tho test, unless they desire to have itdccided and established that the leading of a rebellion against tho Union is not treason. The inevita ble non conviction would give a great and permanent vantage ground to the' votaries of secession and rebellion. Il would be sounded as their triumph throughout tho civilized would. The true policy then, the undoubted pol icy, for President Johnson to pursue, is to pardon the rebel ex-President unlets he is to be tried upon some utiier charge or charges than that of treason—aud to let the the treason question "slide." Iiis pardon would create a general feeling of satisfaction and harmony throughout the North, a universal feeling of that kind through out the South, and a sincere gratification and admiration through out Europe, where as, Mr. Davis's trial for treason would cause exaspera tion in millions of minds, and result in tho utter defeat of tho Federal Gof-' eminent aud the triumph of its en emies everywhe e. Il these truths are not clearly evi dent to the coOtroling minds at Wash ington, we earnestly trust that they will become so in time to prevent in judicious and mischievous action. That President Johnson would pardon Jeff Davis if convicted of treason or at least com mute tho death-penalty to some milder form of punishment, we ■re not permitted to doubt, but, as wa have said, .Jeff Davis cannot be con victed of treason by any jury that can bo made up in the nation, and tb« consequence of an attempt to convict him would be evil, all evil, only evil. f Louisville Journal.
