Among the decision of the N. Y. Court of appeals last teri, was the case of the captain of a vessel, who, having been suddenly attacked by cholera, orally declared his wishes in reference to the disposition of his es tate, in the presence of witnesses. These oral declaration have been sus tained by the Court of Appeals. The Expected Coamet of 1856.-From an article published by an eminent as tronomer,. M. l abinet, member of 'dAcademie des Sciences, the French journals give us some interesting de tails relative to a comet, which, in all probability, will appear somewhere about the year 1856. This is one of the largest comets described by European or Chinese observers. Its periodical course is about 300 years. It was seen in the years 104, 372, 883, 976. again in 1264, and the last time in 1556-al ws described as shining with an ex -terdinary brilliancy. Astronomers had agreed in.announcing its return in 1848'but it his hitherto failed to ap pear, and according to the quaint ex pression of M. Babinet, up to this mo ment, is living on its brilliant reputa. tion! All the observatories -were at first in despair regarding the fate of this beautiful star, and Sir John Her schtil himself had put .crape upon his telescope, when a wise calculator of Middlebourg, M. Bomme, had the good fortune to reassure the learned world that it was not lost to us, as has been feared, but only retarded in its motion. Anxious as all others had been at the non.arrival of this rare and renowned visitor, M. Bomme, aided by the pre paratory labors of M. Hind, with a pa tience and devotedness truly German, went over the calculations, and made a new estimate of the separate and com biaad action of all the planets upon this comet of 300 years. The result of this severe labor gives its 'arrival in August, 1858. with an uncertainty of two years, more or less; so that be tween 1856 and 1860, we may hope to see that great luminary, which in 1556 caused Charles the Fifth to abdicate.. Slocum and Col. Abbott both having testified that these mines were not more than twelve miles south of the village. Capt. Doubleday, who made the map exhibited by the prosecution, was re called by the counsel and examined.- He stated that he did not make accu rate measurements of the distances. his principal object being to get the relative position of the mines and other objects. His original draft of the map was produced and discrepancies point ed out. The counsel for the United States said that they should prove their map to be the best that could be got. Senor Huici, who has been attached to the Mexican Legislation since 1848, identified the signature of Rosas, the Mexican Minister, on papers offered by the defence; also other handwritings and signatures or certificates in the running account book. He also stated that President Arista wrote to the Le i gation commending the claim of Dr. Gardiner to their notice. [N. O. Bulletin. Scene in the White House.--The edi tor of the Erie (Pa.) Observer, under date of March 21, writes to his paper from Washington giving the following amusing anecdote as having actually occurred between the President and an applicant for a village post office ap pointment: By-the-bye, there are some queer scenes enacted at the White House about these days. For instance, the other day a tall son of old Virginia pre sented himself to the President, and shaking him warmly by the hand, ex claimed-" Well old feller. I'm glad to see you. I am; [ voted for yon. I did." " Thank you," says the President, in one of his blandest ways. " But," continued old Virginia, " I voted for you, and now want to be post master down in our village. Here's the dockiments-all on the head; no use examining them, but make out the commission-quick, for I must be go ing." "Very happy to see yon." said P.. "but you must go to the Postmaster General-he has charge of all that kind business." " Postmanser Gleral be t-d :" shouted old Virgicia.
