sponds to Call of Grim Reaper
After Illness of Ten
Months.
Apparently hale and hearty, with all
appearance of excellent health and
having thus reported to his family this
morning, pavid W. Emery, in his
eightieth year was stricken supposed
ly by heart failure af his home, 624
West Main street this morning about
10 o'clock. Telling his wife that he
felt in very good health as she left
the home to go to a grocery a distance
of one block from the residence, Mrs.
Emery, upon returning home, found
him a corpse death coming suddenly
while she was away.
The death of Mr. Emery removes
one the older guard from the city.

nine years was a resident of the city
and contracted as a carpenter and
builder during these years. He was
born in Columbus, Ohio, and came to
Ottumwa from Galva, 111. Arrange
ments for the funeral are not com
pleted pending news from a son ab
sent in California.
The decedefit is survived by his wife
and five sons, Charles of Sacramento,
Cal., Bert, Clyde, Clark and Ben of
this city. One daughter, Mrs.
Burchard Peck, also of Ottumwa.
Three brothers, William and Jason
Emery of Highland Center Daniel, of
Colorado and two sisters: Mrs. L.
Butler of Newkirk, Okla., and Mrs. W.
Kelley of Galva, 111.
Lydia Wilson Dies.
After a lingering illness of ten
months' duration, death came as a
relief to the sufferings of Mrs. Lydia,
widow of the late Joseph Wilson at
her residence, 1226 West street, at
8:35 o'clock this morning. Mrs. Wlf
son was a well known and highly re
spected woman who numbered her
friends by her acquaintances and
whose removal will be learned of
with genuine regret. She was aged
47 years at the time of her death and
had resided in Wapello county for the
past forty-three years. She is sur
vived by four brother^ James Reeves,
of Fremont, Reuben, George and
Theodore, of north of the city.
The funeral will be held from the
residence 1225 West street Friday aft
ernoon at 2 o'clock conducted by Rev.
T. W. Jeffrey. Interment will be in
Ottumwa cemetery.

Washington. D. C., Jan. 27.—The
interstate commerce commission yes
terday decided the cases of the Bea
trice Creamery company and others
vs. Illinois Central railroad and others,
and several related cases, commonly
known as the creamery cases. These
cases are of the greatest importance
to Iowa creamery interests and milk
producers who. have followed them
closely. The decisions were by Com
missioner Prouty, and were in favor
of the complainants.
Several associations and represen
tatives of the department of agri
culture claimed that the local cream
ery method of manufacturing butter
should, in the interest of the public,
be fostered and the centralizer meth
od should be discouraged. The com
mission, however, held that the cen
tralizer'afTords to hundreds of thous
ands of farmers the only satisfactory
method of disposing of their milk and
that the commission's plain duty Is to
establish just transportation charges
in so far as it can be done and allow
these methods to operate under the
charges. The commission held that

it should not establish a scale of
rates with a view, to, and' for the pur
pose of, fostering or discouraging eith
er form of this industry.
The commission has several times
held that where a particular industry
has grown up under rates voluntarily
established and maintained by car
riers, these rates cannot be advanced
without considering the effects upon
that Industry. According to the com
mission, there is no such thing as a
contract between the railway and the
shipper that a certain rate shall be
charged, for the railway rate is a mat
ter of public concern, which cannot
ordinarily be matfe the subject of
private contract but in determining
what is the just and reasonable thing
to be done, the commission must con
sider the effect upon all parties.
The railroads are authorized to
make effective on three days' notice
to the commission such rates as are
required under the commission's
order.
"It seems plain that the duty of
the commission is to establish just and
fair transportation charges insofar as
that can be done. The commission
should not establish a scale of rates
with a view and for the purpose of
fostering or discouraging either form
of this industry," said Judge Prouty.
