Mos remarkable were developments in the investigation be- : fore Judge Whitson relative to the con duct of United States District Attorney ; Ruick. His methods in the grand jury room were shown to have been not only highly improper but absolutely illegal, as we understand the law governing such matters. His display of spiteful ness, the displacement of justice bj a f revenge, the exhibition of 1 spirit venom, the three-card-monte manipula tion of the papers hardly comported with the requirements of official duty. His amazing brazenry, his domineering manner before the jury all give rise to surprise that the members of that body had not thrown him from the room It was his They were the inquisitors, duty to advise them when advice was asked and to cross-examine witnesses to the end that every pertinent fact be brought out. It was no part of his duty to harangue, to dictate, to bulldoze. He insulted the intelligence of every member of the jury, and, moreover, he deceived them and juggled things about until the jugore hardly knew what they were voting on. The large majority of the jury were unquestionably engaged in an honest efforts to get at the facts, Ruick gave them addresses to which there could be no reply at that time, fortunately for his plans, and promises for which he knew there was scant hope of fulfillment. And he didn't care. What he wanted was an indict ment—a certain indictment— with >ut which a carefully planned campaign must fail. The developments show to what ends he went to secure it. It was his purpose to job the thing through evidence or no evidence, law or no law. jury or no jury. The most astounding development of all, though, has to do with the addition of names to the in dictment list alter the grand jury hail completed its work. It was shown by the secretary of the jury that this done. He produced a list of those in dicted by the jury. It did not show the names of "John Doe" and "Richard Poor John and Poor Richard Roe. " were indicted, outside the jury room. Their names were not voted on by the jury. Whoever placed their jtames on t thfc list had i»ist as much right to place the names of any citizens of the state on it. But John anyT Richard on Mr. Ruick 's list, put there? appeard Why were they Perhaps the explanation could be ngitred out this way: Under the federal law and practice persons in dicted jointly cannot testify in behalf of each other. Let ua presume that strong and indisputable evidence was known to be forthcoming in behalf of one of the men indicted. Would it not be an easy matter to shut out that evi deuce by the 3imple announcement that "John Doe'' and the witness were one ami the same? Doe would certainly be a handy person to have on the list if anything of that sort had been contem plated. that the light will be kept on this sit uation until all the dark comers of the official room shall be clearly presented to the public view.
