BE IT ORDAINED by the City of Brownsville: Whereas, the City of Brownsville, Texas, has heretofore ordered that West Thirteenth (Mesquite) street in ssid city from the east line of St. Charles street to the west line of Washington street except inter section with Levee street, to be paved in another unit, be improved by raising, grading, filling, install ing concrete curbs and gutters where such curbs and cutters i re not already installed on proper grade and line, and paving with one und one-half inch Wanenite Bitu lithie wearing surface on two and one-haif inch bituminous concrete base on three inch compressed gravel sub-base, together with all incidentals and appurtenances, and the construction of such improve ments and contract therefor was awarded to and entered into with Southwest Bitulithic comoany; and, WHEREAS, the City Paving En gineer of said City prepared* and filed a roll or statement for the im provements in said portion of street, showing the amounts to be assessed against the various parcels of or in terests in parcels of abutting pro perty and the owners thereof, and showing other matters and things, and the same was examined by the | City Commission of the Ci< of Brownsville, and approved, and time^ LEGAL ADVERTISEMENT and place was fixed for hearing to the owners of such abutting proper ty, and to al! others in anywiee ia terested therein, or having any lien or claim thereon, and due and pro per notice of the time, place and purpose of such hearing was given, and said hearing was had and held at the time and place fixed there for, to-wit, on the 6th day of April, A. D. 1928, it 10 o'clock. A. M., in the City Council room in the City Hall in the City of Browns ville, Texas, and said hearing was continued until all desiri g t» be heard were given full ana fair op portunity to be heard, and the said City Commission having fully con sidered the evidence and all proper matters, the said hearing was final ly closed on the 6th day of April. 1928. and WHEREAS, tha City Commission from the evidence finds that the as sessment sand charges are right and proper and are substantially in pro portion to the benefits to the res pective parcels of property by meana of the improvements in the sold por tion of street for which such assess ments are levied, and establish sub stantial justice and equality and uni formity between the repective own ers of the respective properties or interests therein, and between ell parties concerned, considering the benefits received and burdens im posed, and further finds that in each case the abutting property, or inter est therein assessed, as tha case may be. is especially benefited in enhanced value to said property or interest therein, as the ease may be. by means of the improvements in the said portion of street upon which ■aid property abutts, and for which assessment is levied and charge made, in e cum in excess of the costs of the improvements is in ac cordance with the law and charter in force in this city and the proceed ings heretofore had with reference to said improvements, and ia in all respects valid- and regular. NOW. THEREFORE.
