BOUNDARY FUSS STILL PENDING Attorney General Issues Opinion That Compact Could Settle Fight AUSTIN. June 18,-dPV—'The case fa the United States supreme court affecting the boundary between Texas and Oklahoma is “still open,’’ and the decision fixing the 100th meridian as the boundary be tween the states will not become final until such time as a court commissioner flies his report, At torney General Claude Pollard held today. . He had been requested to answer t number of questions propounded y the Oklahoma-Texas Joint legis lative committee, concerning the status of the boundary dispute be tween the states. He declared that in his opinion the question of fixing the boundary line between the states could be settled by a compace between the two states, and continued: “But, as this settlement would be of a political nature, I am extremely doubtful If the court would adopt the compact as Its final judgment fa the case, and adopt the decisions of the states as to the location of the line as the Judgment of the court. "Notwithstanding this. howe\ter, I am of the opinion that there is no rule of law or custom of the court which would prevent the cause now pending in the supreme court of the United Gtates between Oklahoma and Texas and the Unit ed States from being dismissed by agreement of the parties, on the ground that the boundary line as between the two states has been settled by a mutual compact be tween the two states with the ap proval of congress Congress has already passed a joint resolution authorizing this to be done, and under the decisions of the courts it would not be necessary for any compact which might be entered Into between the two states being further presented to congress for adoption " Committees from the Texas anJ Oklahoma legislatures have been trying to find a way to settle the dispute and let Oklahoma retain approximately 40,000 acres which would be shifted into Texas by fix ing the 100th meridian as the boundary.
