Section 2.—All poles, wires and other construction in the streets, alleys and other public places of the said city shall be located so as not to incommode the public in the use of the streets and under the reasonable supervision of the per son designated by the City Com mission entrusted with such duty. Section 3.—The company shall provide at its own expense on all of its poles space for a pair of wires (provided the same shall not tarry a current that might inter - lere with or be dangerous to the telephone wires and service* for the exclusive use of the city for fire and police alarm system and shall also provide a duct for said wires in its conduit for the said fire and police alarm systems. It is provided, however, that the said city shall pay the said company for all damage to its property by reason of the location, mainten ance and u% of said wires and also provided thit in case any damage or personal injury is caused in any way by said wires being placed, used or maintained on said poles or by reason of any negligence or any acts of omission or commis sion in connection with their con struction, maintenance or opera tion on said poles or otherwise, the said company shall not be in any wise held responsible or liable, and the City of Brownsville binds itself to hold the Rio Grande Valley Telephone Company, its successors and assigns, safe and harmless from any and all liabilities from any and all injuries or damages as may accrue by reason of the con struction. maintenance and opera tion of said wires and the exer cise of the rights hereunder grant ed. oecuon — inc saia company, us successors and assigns, shall fur nish to the city for municipal purposes an agreed number of telephones free of charge; or. if the said company, its successors and assigns, desire, it may. in lieu of said agreed number of telephones, pay the city on the first day of January each year during the exis tence of this franchise and its oper ation hereunder, a sum of money equal to one years’ rental for the agreed number of telephones at the then existing rate for local telephone service in the city of Brownsville. Section 5.—That if in the con struction of said telephone system it shall become necessary to place poles on any of the sidewalks of the city of Brownsville, then the said telephone company, Its suc cessors and assigns, shall have and it is now hereby granted the right to place its poles upon said side walks under the supervision of the person designated by the City Com mission as hereinbefore stated and tc this end the said telephone com pany. its officials, agents or em ployees may remove any and all obstructions thereto, provided, how ever, that the said telephone com pany shall repair said sidewalks and pay any and all such damages to the persons actually injured there by as same may accrue thereto, but provided the negligence of said company is the direct and proximate cause of said damages and injuries. Section 6—The telephone com pany is hereby granted the right to establish new rates as herein after set forth for telephone ser vice but until such new rates are established, the present telephone rates shall be maintained. The new rates, however, shall not take ef fect until the completion of all new work including hte construction of a new ornamental building as spe cified in a letter written by the said telephone company to the city of pven date hereof, but in no event shall the new rate go into effect prior to March 1, 1931. Section 7.—When the building Mid the new construction mentioned ir. the preceding paragraph are •ompleted. the said telephone com pany shall have the right to es tablish the following schedule of rates: Residence wall telephone. $2.50 per month. Residence desk telephone, $2.75 per month. Residence cradle type telephone, $3.00 per month. Business wall telephone, $4 00 per month. Business desk telephone, $4.25 per month. Business Cradle type telephone, $4.50 per month. 8ectlon 8. The company shall maintain and operate its lines and service in an efficient manner snd condition during the period of this franchise, and failure to do so shall come within the provisions of Sec tion 10 cf this Franchise. Section 9. The said City of Brownsville shall not be in any manner responsible for any In jury or damage that any individual may suffer by reason of any acts of ommisslon commission or permis sion on the part of the said telephone company in the construction, maintenance or operation of said telephone ex change system and said telephone LEGAL ADVERTISING company accepting this franchise hereby convenants, grants and binds itself to hold the City of Browns ville safe and harmless from any and all liabilities for any and all in juries or damages as may accrue or in any manner arise by reason of such telephone exchange system. Section 10. If the said telephone company, its successors and as signs, shall refuse or fail to keep and perform any and all of the conditions, convenants. agreements and provisions herein contained, the City of Brownsville may at Its op tion at any time during the con tinuance of this franchise declare the same to be in all things for feited and of no further force or effect, biit provided, that before the same is forfeited, written notice of j the failure or default shall be given I the said telephone company, its successors and assigns, and a rea sonable length of time to correct the same, and upon failure to do so a full hearing shall be given the said telephone company after five <5) days written notice of said hearing. Section 11. That the telephone franchise heretofore granted by the City of Brownsville to the Browns- i ville Telephone Company on the 28th. day of February, 1906. and which Is now owned by the Rio Grande Valley Telephone Co be and the same is hereby in all tnings re pealed and this franchise Is hereto extended to the Rio Grande Valley Telephone Company, its successors and assigns in lieu of and as a subs titute for the above mentioned franchise to the Brownsville Tele phone Company.
