rua-y. A. D. 1930. In a suit num

No 4395. wherein F. L. Duncan is
plaintiff and A. E. Martin, defen
dant, and said petition alleging
that on or about the 20th day of
September. 1928. Plaintiff, at the
special Instant and request of de
fendant. sold and delivered to de
fendant certain goods, wares and
merchandise on the several dates
specified in the verified account
attached to plaintiff’s petition,
whereby the Defendant promised tc
pay the plaintiff the sum of $875 00
at the expiration of 30 days there
after. That the defendant has fail
ed to pay the same or any par’
thereof except $300.00. to the plain
tiff’s damage in the sum of $575.00
