Attorney General's Opinion-It is
Held That Lexington Will Have
to Devise Other Means Than
Those Used at Present.
The State.
Attorney General Lyon has decided
that the action of the Lexington
county dispensary board in appoint
ing a clerk in Richland to receive or
'ders for beer from Lexington is illeg
al and does not come within the pro
visions of the Carey-Cothran act.
The request for an opinion came
from Gov. Ansel in a letter enlosing
a statement from Dispensary Audi
tor West, who had investigated the
matter and thought some legal action
s-hould be taken if the Lexington
board had exceeded its aubhority.
The fight for the control of the
beei trade in Richland county is fa
miliar to the people here. After Let
ton and Watts, beer bottlers, had
presented a petition to the governor
for the removal of the Richland coun
ty board because of their appoint
ment of Charles Narey as bottler
and -the petition was refused, Narey
withdrew from the business and the
Richland board made their purcliases
direct from the factories.
This was met by the purchase of
beer by the Lexington county board
and the appointment o Alderman C.
J. Lyn.h, a business partner of Let
ton, to tie position of elerk to the
Lexington board with orders to de
liver beer in this county when re
quests had been property filled out.
It was on this point that an investi
gation was made and as will be noted
by the letter t-he attorney general
will notify 1)oth the Richland clerk
and the Lexington board of his opin

"Your letter of the 16tbh inst

ing beer in Richland county, is a
hand. Mr. C. J. Lyneh, through hi
attorneys, has also submitted a satte
ment of facts in regard to the moth
ods of making the sales of beer i
ques'tion.
"After a careful consideration o
the facts stated in these communici
tions, I have reached the conclusio
thiat t.he sales of beer as heretofor
made by the Lexington aubhoritie:
through Mr. Lynch as clerk and Mi
Letton as licensed bottler, to person
living in Richland county, in the mai
ner described in either the communi
cation of Mr. West or the statemen
of Mr. Lynch, is contrary to both th
spirit and the letter of the law.
