Carlton & BelLr Anent Ticket Scalping. - Roswell, N. M.. Sept. 29, 1906. To the City Council and people of Roswell: I read with much interest the com munication from Mr. D. L. Myers, traf flc manager of the Pecos Valley Sys tem in recent issues of the local pa pers, and which while elegant adver tising for me contains a few exagger ations not to say mis-statements that I am sure your sense of fair play will allow me to debate briefly. In the first place, Mr. Meyers says that he didn't make any bluff about cancelling special rates to the valley and while it was no threat, he leaves the impression still open that if I am not legislated out of business, they will be cancelled anyhow. That threat is bluff and nothing else. The Santa Fe is too vitally interested in build ing up this country to cancel those rates, tho after it gets the settlers here all favors cease, and it bumps their heads for all they have to have at its hands. It has no favors for the people that really live here,' and Its movements to bounce me off the earth is solely to cut off the relief there is for 'home-folks from their extortionate charges for eastern and northern pas sage. Mr. Meyers' little clause about the terms of sale of the special ticket has nothing in it simply because a con tract obtained by coercion has no le gal or moral standing, and has been so held by all the courts and the com mon sense of the land from the be ginning. Dr. Kinsinger fully covered this point at the last attempt to pass the scalping ordinance. Mr. Meyers says he didn't say that ticket scalping has been abolished ev erywhere, which qualification is time ly, as it flourishes in every town and hamlet in the country, undisturbed save where . the local government is under railroad control. In the larger cities, the scalpers are chiefly sup plied with tickets by general traf fic agents, who want to skin other roads out of trade that would normally come to them. Mr. Meyers' list of becauses is 'ex tensive but fail of weight, Because: The scalper - spends in proportion, teq dollars for the traffic manager's one in advertising the Valley. He stands for a business that is le gitimate in every respect and is never contended against except by the' rail roads who rob the people indiscrimi nately and want to shut off all the re lief the public has. Roswell" greatly benefits by my op erations, for I save them thousands of dollars a year to pay the robber freight rates that must be paid Mr. Meyers and his road. Too bad, I can't scalp in that direction too, most peo ple thinfe The scalper needs Roswell, makes his living here, pays taxes here and attends to his own business, and guar antees every ticket he sells, and Ros well needs him because it requires that sort of citizens to pay the freight demanded by the Santa Fe. The Council guarantees nothing ex cept a fair deal, and in refusing to legislate me out of business no more stands sponsor for me than it does for the Santa Fe Railroad. While the Santa Fe is spending mon ey in East advertisng Pecos Val ley, we Regulars are Paying half the expenses in unjust freight rates, and the new . people will pay the other half after the Santa Fe gets them out here to stay. The needs of Roswell and the rail road are mutual but up-to-date the rail road has cheerfully robbed Roswell, and it is a good bit of cheek to now ask any favors at the hands of those it has perenially despoiled. The railroad may turn down a scalp ed ticket, because it has the might, not the right, but for every such case I return' dollar for dollar, every cent paid for it. The square deal mentioned as ready for patrons at the offices of the Santa Fe consist in paying the full schedule rate, 4 cents a mile to Texico and 3 cents beyond, which is aM that isn't screwed 'down, and would be more if they could get it. If you don't believe this ask them for a rate, either passenger- or freight. Now in conclusion, I want to insist that my business is legitimate, that I am the real friend of the people here and hat until the Santa Fe shows some disposition to quit robbing us, both in ; mileage and " freight rates, they have no right in reason to ask for any favors at the hands of the servants of those people whatever. "The essence of a contract for trans portatlon ! upon a railway is the pay ment of the price charged therefor. The question of person is but an Inci dent and - is Immaterial. The .: ticket is but the evidence of a lawfulcon tractand it is the evidence of a vest-i ed right, as In case of -other contracts. The sale,- transfer or assignment of the ficketand contract -Is not immoral from any standpoint. - It" should not be made so by law. The companies making such contracts and issuing tickets are not Injured, because in no event are they required to do more than perform the contract for which they have, received full compensation.
