It was in the. long drawn ease of Vender II. 1'aino versus John Foster, et nl, lepresenting the townslto trustees. The derision was against l'alno. The ease was begun in the district court February 4. 1SU2, and it has been dragging its weary length utong ever since. The suit is mi Important and Interesting one, in that it involves land wortli over 1,000,000, located on the southwest quarter of uttion nine, and embracing all that portion of Fast Gutlirie lying south of Oklahoma avenue, east of Division street and west of Capitol hill. In the rush to this town on April 22, 1SS9, Paine planted his .stake on the above described tract forty five min utes before thutownslte claimants ar rived. The board contended that l'alno had gulncd possession of the ground for purposes of speculation and not as a genuine homesteader, l'aine at once entered suit through hii at torneys llierer & Cotteral, and volum inous testimony was taken in the local laud oillce, whore the townslto trus tees wore upheld The ease then went to the general land commissioner, who handed down an opinion to the c lVect that Puine's titlo was straight and that lie was the law fill possessor of the tract. The secretary of the in terior nos-t took hold of the now mooted question and reversed the de cision of the general land commis sioner, holding from the testrmony that l'aine had not settled on the laud for homestead purposes.
