Which ever man goes on trial Wed nesday, the defense, it was said last night, will be the same that the Times building was destroyed by gas and fire, and not by dynamite and fire. Out beyond the bills north of town tbere has been conducted a secret ex plosive experiment station where re peated discharges of gas and dynamite have plowed up the earth, that any difference in the action of the explos ives might be shown. Brady ' today riled forma! objections to the approval of the report of Deputy State Examiner R. M. Nash, by the board of county commissioners, which met today to consider the report of the examiner of the condition of the various county offices. The following are Mr. Brady's objections: Before the Honorable Board of County Commissioners of Craig County, Ok- lahoma. ; In. the Matter of the Report of Chas. ! Taylor, State Examiner and Inspec tor, Now on File in the Office of the County Clerk of Craig County, Okla homa. Objection to The Approval of Report. Comes now Edw. H. Brady, a citizen and tax payer of Craig County, Okla homa, and objects to the approval of the above named report for the follow ing reasons, to-wit: I That the state inspector bused his report as to the salaries of coun'y o fl eers affected by said report upon a population different from that which isc provided by law. That the salaries of all county 0T1 cers of Craig county. Oklahoma, for 190S to 1910 inclusive should be based upon the special federal census of 1907, as provided by the state !ey;s,lu tur. That the state examiner and inspec tor has no lgal right or authority to fx the salaries of county oilieorsj of Craiz county or of any oth?r county upon any ether basis than that winch has been provided by law. That the fact that he has based the salaries of such county officers upon a different basis than that provided by law has raised the salaries of some of the county officials, and lowered the saHry of others, which is an in justice upon the tax payers of said county, and an injustice upon such county officials. District Attorney John D. Fredericks, for the prosecution, elected to try him for the murder of Charles J. Haggerty. a machinist, who. with tventy other men. met death in an ex plosion and fire which wrecked the Los Ar.peles Times building October 1. 1910. This case was picked from nineteen indictments because Haggerty's body was found nearest the spot where the explosion occurred. The nineteen charges of murder are against James E. McNamara, his brother, John J. McNamara, secretary of the Interna tional Association of Bridge and Struc tural Iron Workers; William Caplan and M. A. Schmidt, both at large, and four unidentified persons specified as John Doe. Jane Doe. Richard Roe and John Siles. The prosecution contends that the explosion was caused by dynamite; the defense that it was caused by gas. The new Hall of Records, in which the trial is being held. Is only a stone's throw from the scene of the explosion. Counsel for the defense, headed by Attorney Clarence S. Darrow of Chi cago, in questions to the jury and argu ments to Judge Bordweil. sought to depict a mighty contest between or ganized labor, the McNamara's being union men, and its oppents. without much opposition from the prosecu tion. Attorney Lecompt Davis, ex amining jurors, headed straight for this point. "Are you aware that there is a bitter warfare between capital and labor?" he asked Z. T. Nelson, the first venireman examined. "Yes." said Nelson. "And that most men have taken sides?" "Yes." "Have you the opinion that labor unions as they exist are proper, or that they are inimical and a menace " To this the prosecution objected be cause "counsel, in asking the opinion of the witnesses on evidence that may arise during the trial." "He may answer," said Judge Bord weil. and Nelson said he was "not prej udiced." Futher questions were met by the as sertion from. Attorney W, J. Ford of the prosecution, that "this is not a union labor trial." "Do you take the Los Angeles Times?" and "Do you read the weekly page devoted to animadversions on labor?" were other questions put. Nelson still was being questioned when court adjourned until Friday morning. Today is a holiday. It was not until court opened yes terday that the defense could make for mal demand for separate trials for James McNamara and his brother John. Hence the brothers, handcuffed together, were taken to court All Los Angeles knew about this, but when seven deputy sheriffs, beside the jailer and an assistant, left the jail with th prisoners, they found an empty street, except for newspaper photographers and a few stray spectators. In the court room. where only a moderate crowd of spectators gather ed, the formal opening of the case was not heard ten feet from the bar. "Case 6,939 James B. McNamara," said someone casually, after District Attorney Fredericks had announced his selecibn. and the trial was on. John J. McNamara was allowed to remain during the brief morning ses sion, but in the efterroon the younger brother sat alone against the rail. In the afternoon the tables of counsel, which had been arranged in one long line, were changed to face each other. Following a brief recess in the after noon. G. C. Kemp, a venireman, was excused because of physical inability to stand the strain of a long trial. X. . Spalding, secretary of the civil serv ice commission of Los Angeles, was excused by consent of the prosecution after he had refused to plead exemp tion on official grounds and the defense had refused to challenge him.
