It appearing from affidavit filed la this canse that the defendants, Frank Baty and Bettie Baty and the un known heirs of Frank and Detti Baty and Robert Nance and Janle Nance and the unknown heirs of Robert and Janle Nance are non-residents of the State of Tennessee, and cannot be served with the ordinary process of law.
