W. page 436, and from reading section 01(8 of the Ken tucky Statutes, we are now convinced that before electing, or undertaking to elect a County Treasurer, it was first necessary for this court to consider, discuss and vote on the necessity and advisability of creating or establishing such an office, and that no power ex cept this court can determine this question. Dix and moved the court, seconded by Justice G. A. Wright, that the levy in Breckinridge county for the year IOI3 be 18 cents on the hundred dollars in value of taxable property, divided into three funds to wit: General expense fund whichshall Include the salaries of all officers and all current.dxpenses nine (9) cents; sinking fund four (4) cents; pauper fund five (5) cents, and each tax so levied shall not be directed to any oth er purpose than that for which it was levfed, except as prescribed by law, and further that there be levied a per capita, or poll tax on each male, 21 years of age.or over, resident 'in the county aforesaid, of ($1.50) one and fifty hundredths dollars for said year of 1913, and said poll tax so levied shall be apportioned to the following purposes to wit: For road purposes twenty five cents and for general ex pense fund, one dollar and twenty five cents, and said tax of twenty-five cents shall be devoted to work upon and expenses of working the public highway in the district in which it is collected, and further that the levy for road and bridge purposes be and re main at the same heretofore levied; 25 cents on the $100 in value of taxable property, but divided as follows: twen ty cents for roads and five cents for bridges, and further that taxes col lected for road purposes from property situated in each Magisterial district of the county shall be allotted to each dis trict in which it is collected, and the same shall be applied to roads and cul verts in each district, but the taxes collected for bridge purposes shall be expended where necessary in the dis cretlon of the authorities expending same, and further, that all hunds re quired to work on the public highway by law work lour (4) days in said year of 1913, bu,t not more than two (2) days in each week except in cases of emer gency, when said hands may be re quired to work any number of days In the week or year to meet such omer S FOR SALE! And whereas, at a meeting of the County Board of Education of Brcck. inrldge county, held on March 21, 1913, it was ordered that an advalorem tax of 20 cents on each $100 worth of tax able property, and a per capita tax of $1.00 on each male citizen over 21 be levied except such property as is ex empt by law, artd whereas, a copy of said order has been presented to this court, it is ordered that the school tax for the year 1q13 as provided Sees, 08 and 00 of the School Laws of 1003, be 20 cents on tho 100 worth of taxable property, and a poll tax of $1,00 on euch male citizen 21 years of age or over, resident In Breckinridge county, Kentucky, except in the Cloverport Graded School District, and such other Graded Sohool Districts, and such oth er instances as are exempt by law, and a vote being taken on said motion, the yea aud nay vote resulted as follows: G.
