The suit of Kleinhans Simon
son against Samuel H Jones of
Philadelphia and others seeking
to enforce a contract for the pur
chase of the Oak Hall property at
the corner of Fouth and Jefferson
streets Louisville was decided in
the United States Court in that
city Tuesday morning by Judge
Barr in favor of the defendant
Kleinhans Simonson entered in
to a contract with Dr Pope

Jones who accepted tne terms

tract in writing was drawn up at
Louisville which however
differed with the contract com
municated by telegraph prin
cipally in that a commission was
provided for John A Stratton
Co the real estate agents Jones
then refused to deliver a deed to
the property and subsequently
sold it to Messrs Crutcher
Starks Kleinhans Simonsons
suit for breach of contract followed
Messrs Crutcher Starks will
tear down the old building and
erect a handsome new structure in
its place in a short time

Senators Lindsay and Black-
i burn have succeeded in getting
the appropriation for the im
provement of the Kentucky
river in the River and Harbor
bill increased from Siooooo to
200000 and the bill has been
reported to the Senate with the
increased amount in it The Sena
tors will doubtless have no trou
ble in making the amendment
stick in the bill until it goes back
to the House where Gov Mc-
Creary and Col Al Berry will
see after it With this increased
amount lock and dam No 7
should be gotten well under way
this season

We called attention to the fact
several weeks ago that the im
perfectly constructed sewer run
ning south on Main street from
the intersection of Third South
Frankfort would prove a pesti
lence breeder as it has no traps or
catch basins and is scarcely covered
with earth in many places At the
time we wrote the former item a
gentleman in the immediate vi
cinity was suffering from an attack
of typhoid fever and now a bright
blue eyed little girl is dangerously
ill with diphtheria just across the
street from where foul gases are
continually issuing from the mouth
of this sewer Diphtheria s
known to be one of the most fatal
as well as most contagious of dis
eases to which children are sub
ject and within the distance Jof a
block east and west from the
point named there are fully
children livincr It seems
to us prompt action should at
once be taken to abate this nuis
ance before this dreadful disease
begins to spread and the lives of
all the little ones in that section of
the city be endangered
