no recollection of the note, of having endorsed H, or of having received notice, and therefore he put the complainants upon full proof of those matters. This was only saying, you sue mo on a lost note which yon describe, and say I en dorsed it and that I was duly notified of its non payment at maturity: I have no recollection at this day of such note, endorsed. &.C., and there fore it is, | cannot feel hound to pay unless you make proof of the matters alleged. At the peri od given as the date of the note, as we are in formed and believe to be true, Mr. Walker hail made more endorsements for the accommoda tion of his friends than he, or any oilier man, though wholly unoccupied with public affairs, could, eight or nine year afterwards remember, unless he had kept a registry of them ; and every one who knows Mr. Walker will he well satisfied of the entire truth of his answer. When he speaks of the indemnity alleged to have been re ceived, his denial is positive. If then. Mr. Wal ker has denied that he “ swore of” his liability, he asserts the truth, for his answer shows the charge to he totally baseless. We have made this statement as Mr. Walker's counsel, with the records before us, and under the belief it was our duty to him. in that relation, to correct im mediately, what in effect is a calumny, impeach ing his moral character.
