DECISION AFFECTS CHELAN CASE Council May Retain Balance of Li cense Money and Need Xot Refund. The supreme court of the state of Washing ton has just handed down a decision in a case involving a forfeited liquor license, which will probably have a strong bearing i i the issue of the case of Josh Clary against the members of the Chelan town council and others. A dispatch from Olympia says: "When a saloon keeper is con victed of selling liquor to a minor a city council has the right to revoke his license and retain the excess license money paid for the issu ance of a liquor license, is the text of a decision of the supreme court today. The appeal was made fby Arnold Krueger in a suit against the town of Colville for the return of $625 license money. "Krueger conducted a saloon, having received a license April 1, paying $750 for it. He was fined for selling liquor to a minor, and the city council revoked his license in July. He asked for the return of the license money, and the lower court sustained a general demurrer to the complaint interposed by the town. "Krueger mpealed on the ground that to retain his license money; was in violation of the constitution.! as ; * gave the city the right to take his property without the process of! law. "The supreme court upheld the Judgment of the lower court."
