Federal Judge W. T. Newman de
nied a petition for Frank's release
on a habeas coitus writ and a peti
tion for an appeal was Immediately
presented. It will be passed on by
Judge Newman Monday.
There was some confusion regard
ing the appeal and at first it was
announced that Judge Newman had
granted the petition. The Judge
stated tonight, however, that his an
nouncement that lie was "inclined
to grant the appeal." Under a fed
eral statute a federal judge, in grant
ing an appeal in habeas corpus pro
ceedings must issue a certificate stat
ing that in his opinion there is "prob
able cause for an appeal."
The habeas corpus writ -was sought
on grounds that Frank's constitution
al rights -were violated, in that he" was
"involuntarily absent" from the court
room when the verdict was announc
ed. The prisoner's attorneys argued
that the Georgia state courts lost Jur
isdiction In the case when he was de
nied the right to face the jury at the
culmination of his trial.
They declared therefore that Frank,
had been deprived of his liberty with
out due process of law.
A writ for a Supreme Court review
of tho case recently was denied by
both state and federal courts in a
proceeding based on practically the
same contention, but not involving a
habeas corpus petition.

case of William V. Clary, indicted
for the murder of Eugene M. Now
man, his son-in-law, in Haverstraw on
July 23, returned a verdict of not
guilty in Justice Morschauser's court
Saturday night. Cleary was at once
discharged from custody.
The Jurymen looked solemn as they
filed into court, and resumed their
places. Cleary's eyes were directed
appealingly towards the foreman, who
rose after the names .of the Jurors
had been called by the clerk and in
answer to Justice Morschauser's ques
tion if a verdict had been reach, said:
"We have, Your Honor?not guilty."
The announcement had a palvanlc
effect upon Cleary, who sprang to
his feet and advanced toward the Jur
ors with beaming face and outstretch
ed hands. "A merciful and right
ful verdict," he said as he grasped
the hands of the Jurors, "and I thank
you for It."
The meeting of Cleary with his wife
in the county Jail was pathetic. Mrs.
Cleary fell into her husband's arms
with a cry of Joy, and a few minutes
later they were driven to the Cleary
home in Haverstraw in an auto, where
they spent the night. They will leave
for the tropics within a few days.
News of her father's acquittal was
sent to Mrs. Anna Cleary Newman
by her mother a few minutes after

Ambassador "Big Jim" Sullivan,
the Now York City lawyer, who was
named minister to Santo Domingo by
Secretary Bryan some months ago

his administration, has been sent
back to his post by Secretary of
State Bryan. Now newspapers have
tegun an attack on him alleging
that he might aid financial interests,
which wish to exploit the Island.
Mr. Vick was commissioner of cus
toms on the island, having been ap
pointed by the President. He re
turned and offered his resignation
bccatise he did not care to work with
Sullivan.
