THi: STATICS DKCLARATION.
In his' amended declaration Attorney
General Fltts sets forth, In substance,
that on the different dates named in
the dllforent counts then, w-as shipped
over the defendant's railroad located
entirely wllhtn thl State from Al
biirgh to Watcrhury a quantity of coal
which the State had purchased for the
hospital at Waterbtiry fioin the George
Hall Coal company; that thu defendant
charged and collected from the oal
company as freight 011 t!,.. coal tlie sum
spfcified in ear h count m excess of
the freight rate then 1 hargcil by and
In fone upon said railroad for hauling

that tho State was compelled to nnd
did ply the coal company as a pa it of
the purchase price of the inal such "
cesv freight, and t lint such excess
freight was charged and added to the
price of the coal by the conl company,
thereby making tho price of coal de
lli'ired to the Ktato at Waterbury ,;n
mu Ii more
What is here to be determined !.- in
substance: Is the .State of Vermont the
party aggrieved bv the ohm-ire nt the
excessive freight rate? Tlie coal, it is
alleged, was "sold ami shipped ,y the
coal company to the Stale of Ver
mont." The coal company wa.i the
consignor, tlie defendant was the car
rier, the plaintiff was the consignee
This ft eight was charged anil added
to the price of the coal which price
was that much higher by reason there
of. i'he plaintiff was directly .1 pirty In
intfi'ost to this freight rate. The matter
really concerned only the plaintiff and
defendant. As the declaration states it,
it muttered not to tlie coil company
whether there was this excessive charge
or how much the exces-s might be.
It was clearly not intended that thu
right to recover should exist only in a
consignor. i'he statute s in no sopse
penal. It seeks only to make whole any
one who has suffered by the Imposition
of an unlawful rat" of freight. It Is only
actual damages which can he recovered.
Just enough tn make the aggrieved party
whole. A statute which l remedial, as
this plainly Is, should be construed
liberally because Its primary ohiect Is
redress and not punishment.
THU ALLKGHD RLHATK.
It is also nlleKcd that the Central Ver
mont Railway company gavu the George
J. Hall Coal company n preferential rate
of .'i0 cents per ton under tariff rates on
the coal to Watorhurt .
Tho claim of the Slate is that by Ijw
(section 3:iCJ V. S.) the railway company
was bound to git" to vterjone else tho
same rate it gave to the George Hall C0.1l
company and tli.it the State was r milled
to the benetlt of such competition as con
ditions of trade might bring in the matter
of price of coal delivered at Waterbury.
Tho State, therefore, suffeicd, as is al
leged, tlfty cents per ton. Is it a parly
aggrieved under section 3fol, V. S. ?
Tho statuto Is plainly remedial. The
right of recovery Is limited to "damages'
sustained." It seeks to euro the mischief
by putting all pintles on an even basis
It the meaning of the statute Is doubt
ful, a libeial construction will place the
plaintiff within Its scope, That liberal
construction Is, warranted, yes, demanded,
for renicdlcal statutes .mould be liberally
construed to advance thu remedy, If the
meaning Is doubtful, and to bring within
the scope ot their operation all cases that
come within the mischief Intended to be
remedied
Till-: SUMMING CP
In (losing, Mr. Fltts suld: "Tho analj--sls
or thu situation shows that nobody but
the plaintiff could riulntnlu an action. A
moment's consideration will eliminate flic
suggestion that any compelltu; coal com
pany could recover under this section. If
the Citizens' Coal company of Hurlington
brought suit, It would bo clear at once
ths Its situation was far too remote,
Such a company might claim that had It
had the earn rate the Cieorns 11x11
Coal company, It might have secured the
tr.i le for the hospital at Waterbury, and
made a proMt thereon. Hut It would b-
' illation merely. Tho George Hall Coal
. uiipaiiv Is, certainly, not aggrieved."
' The only party aggrieved within ti,"
mranlng of tlie law is tho State or Ver
mont. H the plaintiff hero cannot recover,
then there Is substantially no remedy for
the vrry great evil which tills statute
seeks to correct. Railroad corporations
may with Impunity grant secret rales to
the consignor of freight and let such con
signor stlllo competition and gain for It
self substantially tho whole of the tils
'rimlnatinn In rale, simply hy seeing to
It that the consignor sells his goods f. o
b. at the point of delivery to the con
signee. That cannot bo tho meaning of
this law."
Jl'DOj; POWKRS'S ARGUMENT.
In Ills argument for tho defendant com
pany, Judge Powers claimed that whether
or not such a rebate bad been given, it
bad not been tiiken advantage of, tin, I
that conseiiuently neither the State of
Vermont or any body else had been dis
criminated against or Injured. He also
argued against the plaintiff .construing
the word "terms" to mean rates or tolls.
It might mean conditions, benefits, con
ditions or facilities. The law says the
rate must be o'tual and reasonable, but a
reasonable nto may not bo an equal
rate.
Judge Powers alo argued that the
State had no right to complain In this
ci sc. If coil has been delivered nt Water
bury for tlie asylum at a less price than
It has been to Jones or Smith, they and
not the State should complain,
The State claims that about .O"0 tent
were delivered nt the asylum at tho .V)
cents per ton reduction rate, making tlio
total rebate SlO.WiO.

SUBMARINES TO GO
TO THE PACIFIC COAST.
Washington. D C. Jan. :9 -The navv
department is about to undertake ,i sris
of experiments to demonstratn the utii ty
of tho submarine as nn adjunct In naval
warfare. Heretofore the department has
contented itself with tests of these boats
limited to the development of the'r ab i v
to mako short submerged runs, to dive tt
will, to direct their courso with reason
able precision under water and to d s

Tlio longest enduranco test yet made,
covering a little over a. hundred miles,
has dot-eloped tho difficulty of sending
these boats unaided for any conslder.iblo
