Sixth The court instructayou that if you tind from a preponderence of the evidence that the plaintiff complied with the law as in the preceding instruc tions and acquired the right to the use of the water of Reservation creek there by and that since that time he has main tained his ditches, heedgates and fumes and continued to use the water for bene ficial purposes upon his laud during the irrigation season ot each year until in terfered with or obstructed from so do leg by the defendant, then and in that event you will find for the plaintiff, not withstanding the defendant might have complied with the law as to the acquir ment of a water right, if you find that the dfendant's rights were acquired subsequent to those of the plaintiff, be cause the law is first in time, tirst in right. Seventh --The court instructs you that in matters of water rights the first one in time, is in the law first in right. other things being equal; and in this connec tio, if you tied that the plaintiff ac quired his right prior to that of the de fendant, although the defendant might have complied with the law, yet you shall nevertheless fald for the plaintif, it you find him a preponderance of the evidence that defendant interfered with and obstructed the plaintifts rights in the premises. Mace. then the defendant is entitled to the use of such water to the greatest amuount which the jury may believe from the evidence would run at the dam and ditch of the defendant. and would not reach the headgate of the plaintiff, and even though the jury may find from the evi deuce that the plaintiff. Mace, is entitled to a priority of water right over the de fendant Lewis. yet if there is water in said creek which would be available to the defendant for the purposes of irri gatin, and would not beavailable tothe plaintiff, then the defendant would be entitled to such of the water from said creek as would not be of benellcial use to the plaintiff. Sixteenth-Tbe jury are instructed that although you may believe from the evidence that the plaintiff filed a water right in the ofice of the county clerk of Custer county in 186.claimingthb right to divert 3000 inches do water from Rse ervation creek, yet all that the plaintff is entitled to under such claim of right is the amount of water which he had actually appropriated and was using or needing and prepared to use. at the time the defendant tiled his ater right. and was ready by mesas of ditch and dam to use water from said creek to which the said plaintiff was not etitld;and in de termining the plaintiff's right in such filing, be could not go beyond the amount which he was prepared by his dam and headgate and ditch to carry from said creek, and if at the time the defendant was prepared under the law, to use water from such dich, the plain tiff bad a dam and headgate and ditch suJc.ent to carry only 44 inches of water, then the plaintiff could not claim, after the rights at defendant had inter vened maoe thau the said 40 inches of water. Nor could the plaintiff claim to the amount of 46t inches. nor any other amount greater than )l was prepared to use for beneticial purpoes. ' w Twentieth The measuret ment of water appropriated under this chapter shall Ibe condctted in the following manner: A box or flume shall be con strneted with a tbedlgate placed so as to leaese an opening of six inches . tween thr Ibottomi of the box or flume and low er edge of the headgate. with , slide to enter at one side of andof sefiicieint width to close the opening left by the head gate. by means of which the dimensions of the opening are to be adjusted. The - box or liumne shall be placed level. and so arranged that the stream in passing through the aperature is not obstructed by hack water. but before entering the opening to , meiasured the stream shall be brough to an eddy. and shall stand three inches on the headgate anti above the top of the opeting.
