The minera of eaoh mining diatriot may make regulations, not in oonfllot with the laws of the United Steles or with the laws of the Bute or Territory in which the diatriot is situated, governing the looatioo, manner of re cording, amount of work necosaary to hold possession of a mining olaim, sub ject to the following requirements: The looalion must be distinctly marked on the gronnd by posts or monuments ao that Its boundaries oan be readily traoed. All reoords of mining olaima hereafter made shall contain the name or names of the locators, the date of location, and suoh a description of the olaim or olaima located by referenoe to some natural objeot or permanent monument aa will identify the claim. On each olaim looaled after the tenth day of May, eighteen hundred and seventy-two, and until payment of the purehaae money and oertifloate of entry has been issued therefor, not lesa than one hundred dollars’ worth of labor ahall be performed, or improvements made during each year. On all olaima looaled prior to the tenth day of May, eighteen hundred and seventy-two, ten dollari’ worth of labor shall be performed, or improvements made, during eaoh year for each one hun dred feet in length along the vein, until payment of the purchase money and a certificate of entry baa been Iaaued there for; but where snob olaima are held in common auoh expenditure may be made upon any one claim. That the period within whioh the work required to be done annually on mineral olaima shall oom menoe at twelve o’olook meridian on the first day of January suooeedlng the date of location of auch claim. When the labor required by this Aol ahall have been performed, or improvements made, an affidavit may be filed within thirty daya alter tne time limited lor performing toon labor, or making aneb improvement!, with tbe reoorder of deed* of tbe ooonty in which the olaim or mine ia situated, particularly describing the labor per formed and tbe improvements made, and value thereof, wbioh affidavit shall be prime facie evidence of the fact therein stated, and upon a failure to oomply with tbe conditions of this Act in the perform ance of labor or making of improvements, tbe claim or mine upon whioh such failure ooourred shall be open to relocation in the same manner as if no looation of the tame had ever been made; provided, that tbe original locators, their heirs, assigns, or legal representatives do not resume work upon the olaim after snob failure and be fore such relooetion, and oontlnue tbs tame with reasonable diligence until the required amount of labor shall have been performed or Improvements made. Upon the failore of any one of the several oo owners to oootribute his proportion of the expenditures required hereby, the oe-own ers who have performed the labor or made the improvements may, at the expiration of the year, give such delinquent oo owuer personal notioe In writing, or notioe by publication In tbe newspaper published nearest the olaim for at least onoe a week for ninety days; and If at the expiration of ninety days after such notioe In writing, or by pnblloatloo, such delinquent shall fail or refuse to contribute hit proportion of the expenditure required by this eeo tion, his interest in the claim shall beoome the property of his oo-owners who have made the required expenditures. The* section twenty-three hun dred and thirty-four of the Revised Stat utes be amended by adding thereto the fol lowing: "An! the surveyors appointed under the provisions of this ssetion shall have power to administer oaths to their assistants." Beo. 8. That aeotion twenty-three han end thirty-five of the Revised Btatulee be amended so as to read: "Beo. 2335. All affidavits required to be made under this obapter may be veri fied before any offioer authorised to ad minister oaths in the State or Territory where the claims may be situated having an official seal, and all testimony and proofs may be taken before any such offioer, and when duly certified by the offioer taking the same, attested by his seal of offioe, shall have the same force and effect as if taken before the Register and Reoeiver Of the Land Office.
