Act No. 9 of 1874, one of the many sets passed for the beneit of the Lou isiasa State Lottery, is clearly useom stitutiocal, because it coafers upon committing magistrates powers which the Constitution expressly says they shall not exercise; power to fine and imprison any person or the sale in this State of lottery tickets other than those of the Louisiana State Lot tety Company, from which the defen. dant has not appeal, so that such a ease cannot be properly brought before the higher courts for a decision as to the eonstitmtionality of the set. Several parties have recently been arrested and brought before the City Recorders of Louisiana under this aet. Record er Miltenberger took what we con sider the right view of the matter that the Legislature could not confer apes him powers which the Coasti tstios forbid his serdlsg; anad while bhe did not elai the privilege of passing opon the onstitutionally of the set, he did claim the right to re. fuse to violate the Constitution whichb he is swore to support by exercising authority that is forbidden by the Constitution. Recorder Smith, on the other band, takes the position that be has so right to decide upon the coontitutionality of the act, and that he has to enforce the act just as be ads it Of the two Re corders, it strikes us that Mr. Miltea berger has far the soundest anad most reasonable viws of this matter. While a magistrate may codsider that he hasu o the right to decide upon the contittionality of an net, he eertainly not only has the right, but Is sworn to exercise it, to refuse to do what the Constitution says be shall not do, and so power on earth ca compel him to do otherwise. --- - .s.--- - Cosependec far toe Basems. As treasurer, I have, at tiotes, several thousand dollars in cbarge. I have no safe plact to keep it here, and for this reason the money is deposited with the hank acting an fiscal agent of the State. The Sebool Board knowsn this, abd I have always asked thesa to notify me in advance of the amount nt:eded to pay teach ers, so that I could have the nmoney on hand. Generally, they have done so, and I have had the money bere to meet all warrants. In the ease of Mr. Bryan there was no ocial notice given -ne that the warrant was to be drawn; in fact, there bad been no meeting of the Board to pass on claims, and I could not anticipate that the warrant was to be drawn. Hence, I was forced to give the check. But had I expected a warrant would have been drawn on me; the money would have been here. This is ny first communication for a newspaper; I hope it will be nmy last, as I shall not allow myself to be drawn into a newspaper controversy. Yours respectfully, J. W. Simms. A. Unjust Indictment of the Hoath. [From the New York Sun, May 13.] "What the slaveholers's rebellion failed to achieve by force to-lay stands awrmlnplished by fraud. The Government of lthe United States, whicht the southern armies were un able to overthrow, has been undermined by corruption. It is nut surprising to find some of those who were moat active in the futile attempt to de-troy the Goernment by arms now delving undelr its ieanuations with the devices of frautd. It is quite consistent kor various Southern rebels, now yclept Democrats. to botlster up Hayes in the etlce of Preideltt. There is no other why they colld do so mnah as destroy the Government against which they once openly appeared in hattle array, sad which there is of late too much reason to be lieve they still regard with feelings of hatred -in this crisis extremely ill concealed. These modern serrvile Sllowers of the determined Southern eonesirators had their prototypes in the Northern doughfaces of the days of slavery. The people see into the true condition of things. The day of retrilmtion will come! The above unjust and ises attack was wade on the Democratic party by the New York Sne after the Florida eoofessions were made, but before the resolutions to investigate the frauds confessed were introduced inato Congress; but we have not sees any retraction on the part of the Sun, although the Tresolutions were sup ported by the Democrats and opposed unanimously by the Republicans in Congress, who have continually re sorted to the trick of breaking the quorum in order to defeat the investi gation,, which many of them had previously claimed to desire.. They do not want an investigation, because they know very well that it would expose their own guilt, for all the leaders of the Republican party were parties to the frauds, or they were at least all cogniant of the facts.
