That their issue was in violation of the State constituti.onal limitation of the publio debt, m,000000, which was in force at the ti.me of their lsen." Even if therlewas no constitutional lifita tion of the pnblio debt of the Stateat the time these bonds were issned, still they and every one of tnem are null and void, because none of the conditions upon which their mlese was an thorised was or has yet been fulfilled. Bet the Legislature was not esapaciated to anthorise the issue of these or any bonds of the State at the date of the passage of Act No. 95-of 1871, because the amendment to the constitution limiting the State debt was adopted in Novem ber, 1870 several months prior to the passage of Act No. 95 of 1871. The limit of the State debt provided by the amendment to the constitution had been reach. ed and exceeded prior to the passage of act Ne. 95 of 1871 authorizing the issue of these nds. By this onstictional prohibition the on were tricken with nullity at their birth. It is therefore ordered, adjudged and de ereed that the injunction granted in this case be made perpetual.
