It is not our purpose to give an ex tended biographical notice of tho above namod gontloman, who is now brought into connpicuity by his can didacy for County Judgo, but more ly to uoto ft fow pointB in his careor for tho benefit of the newer class of our citizens. Captain Storoy is a native of Geor- gia, ana nrst came to icxas in iuo winter of 184!), settling in Gonzales county. In 1849, while a resident of Caldwell county, he attended school iu San Marcos. Ho took up his rosidenco in this county in 1853. Ho was elected clerk of the courts, and scrvod five years as such before tho war. Whon tho war came ho en teral tho service and did his duty faithfully as a soldier and officer. After tho war ho was appointed pre siding justice of tho county by Gov. Hamilton, and afterwards elected by the people, but was romoved from office after tho romoval of Governor Throckmorton. With the exception of a term as Representative in tho Legislature, wo beliovo ho has sinco remained in privato life, in which ho has ever manifested tho best traits of a good citizen. This passage of Soripturo remains applicable to all quostions whero there is an acknowledged rule or standard for thoir Bottlemont In accordance therowith, we refer to tho Report of tho Finance Committoe and the law adducod by thorn for the settlement of tho quostion raisod by Judgo Kone in last week's Cresset, as to the truth of .the editorial paragraph Jn our last entitled 'Noods Looking Aftor. careful porusul of said Report wil show that we gavo tho "substantial facts" of tho matter, as we then stated. We mean' of course that por tion of the Report which speaks of the misappropriation of the schoo funds, or failure to invest according to law said funds. What are tho facts as stated in said RoportT Why, first, that tho county owes to the por- manont school fund tho sum of $1, 441.70, which has boon borrowed and usod by tbo county for the purpose of paying a dobt of tbo county, viz.: tho interest accruing on county bonds; and, second, that thore is now in tho hands of tho County Treasurer the furthor Bum of $1,282.07 in cash belonging to said permanent school fund, which has not been invested in bonds as diroctod by law, making altogether $2,724.67. none of which has been applied thus far as tho law directs Tho only mistake we made was as to tho amount, and as wo took no notes of our brief and casual conversation with Mossrs. Groon and Gioson, sooms we misunderstood thorn on that point. In all olso the report bus tains us. It shows that this largo sum of $2,724.07 Bhould have been investod in interest-bearing State or United States bonds, and of courso tho loan to tho county of a part of it and the rotaining idle in the county treasury of tho remainder wero plain violations of tho law. In proof we quoto from tho law itself as referred to by the committoe, boing a clause of Section 6, Article 3703, Rovised Statutes. Aftor providing for the disposal of the school lands by the soveral counties, it closes thus: "Said lands and the proceeds there of, whon sold, shall be held by said countiou alono as a trust for tho ben efit of publio schools therein; said proceeds to bo invested m bonds of tho Stato of Texas or of the United States, and only tho interest thereon to bo used and oxpendeu annually. From the above it will be apparont that the law has not been tracked in several important respects. There is a constitutional provision that "no law oven shall ever be enacted appropri ating any part of the pormanent or available school fund to any other purpose whatovor.'' And tho clause wo bavo quoted above in full express ly provides that the proceeds of the Bales of school lands "nhall be held by mid counties alone as a trust for the benefit of public schools therein; said procoods to bo investod IN BONDS OF THE STATE OF TEXAS OR OF THE UNITED STATES, and ONLY. THE INTEREST THEREON TO BE USED and expended annually." It is manifest from the above that $1,441.70 of tho permanent school fund has been applied by our county authorities having charge of the same contrary to law, and that $1,282.97 have not boon loaned out as tho law directs. It is clear tho first named sum will have to be paid back, and ultimately raised by taxation. Mark, wo do not impugn the mo- tivos of Judge Kone- and our County Commissioners; thoy no doubt meant well. But wo submit whether publio officials should not 6et tho cxamplo of a strict compliance with tho plain letter of tho law. We will only add that wo do not think Treasurer Patterson can be justly blamed for tho above state of facts. It was not reasonably to have been expected that be would act contrary to the directions of tho uounty Judge and Commissioners. To Hit Jtmor, Jmlg Teich'mutHer: We, a committee appointed in ac cordance with Article 080, Revisod Statutes State of Texas, respectfully represent thutfouryeara have olapsod since a coinmittoo of this charactor has offioiated, (an evident laxity Bomo whore). The occasional appointment of such committees gives to them an mquisi torial character, and just pending l oounty oloction the opinion prevails in Bouio quarters that the investigation iu made with a view to influencing some spocial intorosts. Thore has Leon dereliction in such investigations. They should have at loost been annual, if not an incident of the proceedings of each term of the District Court. We therefore bog your Honor's permission to say tbat we heartily approvo of the action (incumbent on you under the law) that you have taken, and respectfully suggest to your Honor and tbe Hon orablo Grand Jury that such investi gation should be in the future a mat ter of duty at each rocurnng term of the Court We have carefully investigated all matters for tho last fiscal yoar, and thereby establish data upon which subsequent committees may base their reports. We have found as follows: In the offices of County Judge, bhenS, County Treasurer and County Clerk all monies have boon accounted for, but tbo accounts have not been kopt in that eystomatio manner provided for and contemplated by the law. We respectfully suggest that those accounts date from the next fiscal year and thoreaftor be regularly kept in the manner prescribed by law. We find tho financial condition of the county aB follows : The county is indebted to Court House bondM, redeemable at tho pleasure of the couuty, bearing C per cent, interest per annum, duo the State of Texas. $26,000 00 Bonds bearing 8 per cent, int'rost per anuum,due uoatmeuB' ttuv- lncH Bank, St Louis 3,000 00 Juil Bouds due the State, 6 per ceut interest per uunum, pny. able annually in April of each year ",750 00 The interest on all these bonds has been paid promptly as it matured. The county also owes to the per manent school fund tho amount of ,441 70, which has beon borrowed from this fund during the years of 1883 and 1884,and has been used for tho purpose of paying interest accru ing on county bonds. We find in the hands of tho County Treasurer the sum of $1,282.97 in cash belonging to the permanent school fund, and we recommend that this amount, with the above amount of $1,441 70 duo by the county, shouldbe invested into interest-bearing State or U. S. Bonds, as the law provides (Art. 3703), and that the county should pay a reasonable rate of interest on the school money it has used.
